Abstract

This paper investigates the structural limitations of Korea’s centralized regulatory policy framework and explores the necessity and feasibility of introducing a decentralized model of regulatory exemptions that accommodates regional diversity. Existing regulatory exemption schemes have largely confined local governments to a nominal role, with substantive authority retained by central government bodies. Drawing on the theory of Regulatory Federalism, this study proposes an institutional redesign that reallocates regulatory authority to enable local governments to take a leading role in the formulation and implementation of regulatory exemptions. A three-phase model for the gradual delegation of authority is presented, designed to balance regulatory efficiency with local autonomy. In addition, the paper highlights essential governance components—including policy flexibility, accountability mechanisms, stakeholder engagement, and feedback systems. The study concludes that enhancing regulatory effectiveness and democratic legitimacy in Korea requires a shift toward horizontal, cooperative relationships between central and local governments.
