금융기관 정리체계의 국제 동향 및 시사점

세계적 금융위기 이후 국제적인 대형 금융기관의 도산이 잇따르면서 금융기관 정리의 혼란 및 비효율성과 공적자금에 의한 구제금융의 문제점에 대한 각계의 비판이 제기되었다. 이에 국제적으로 금융기관 정리체계에 대한 관심이 크게 증대되었으며, 주요국을 중심으로 관련 정책들이 심도 있게 논의되어 도입되는 추세에 있다. 최근 논의되는 정리체계 관련 핵심 내용은 감독권역과 관계없이 시스템적으로 중요한 금융기관의 지정, 공적자금에 의한 구제금융이 아닌 당사자 손실분담, 일국의 개별 회사가 아닌 다국적 금융그룹 전체의 체계적 정리, 그리고 사전적으로 위기 상황에 대한 계획을 준비하는 회생 및 정리계획 등이다. 우리나라 역시 이러한 국제적 변화에 대응하여 주요 방안들의 도입을 적극적으로 고려할 필요가 있다. 특히 금융회사 감독 및 정리 관련기구간의 정보공유 확대, 정보수집 기능 강화가 필요하며, 사전적 개입이나 사후적 절차 진행과관련하여 주된 정리 기구의 역할이 크게 강화되어야 할 것으로 판단된다. 아울러 국제적 규범의제정 및 공조 방안에 대한 논의에 적극 참여하여 향후 국내외 대형 금융기관의 부실에 대비한 효과적인 정리체계 마련에 노력을 기울여야 할 것이다.
Abstract
As major financial institutions went bankrupt during the recent global financial crisis,worldwide efforts for establishing effective resolution regimes have been made to avoideconomic losses from future financial crises. This paper especially focuses on designation of systemically important financial institutions, introduction of bail-in debts, resolution procedure for multinational financial institutions, and recovery and resolution plans of large financial institutions. Based on the analysis of recent development abroad, we make several proposals to set up effective resolution regime in Korea.
