이 논고는 헌법에 보장된 대학의 자유에 대한 시론이다. 모든 생명성의 원천은 개체성에 있으며 개체성의 원천은 자유에 있다는 전제하에 대학도 하나의 생명체로서 자유를 보하지 않으면 존재하고 성장할 수 없다는 관점으로 대한민국 대학의 자유에 대해 검토하고자 한다. 다만 대한민국 대학의 자유는 완전하지 못하고 그로써 대학의 생명 또한 완전하지 못하다는 입장을 견지하며 그 논거는 서구대학들이 탄생 과정에서 신으로부터 선천적 자유인 Freedom을 부여받은 것으로 그치지 않고 성장 과정에서 스스로의 노력으로 후천적 자유인 Liberty를 쟁취하여 왔다는 역사적 사실에서 찾아보고자 하였다. 따라서 이 논고는 대한민국 대학의 생명성이 freedom과 liberty를 모두 갖춘 온전한 자유를 어떻게 갖추어 나갈 것인가에 달려있음을 밝히려는 것이다.
Abstract
This article is about the freedom of university which is stated in the Constitution of Republic of Korea. The position taken by this article is based on the proposition that a university cannot exist without its freedom and liberty which is the given condition of life and its individuality. By the way, the freedom and liberty of Korean university is not completely secured yet, which means then its life not matured as much as European universities who have been endowed or inherited with the freedom from God and equipped with the liberty acquired by themselves over the struggles for survival. Therefore this article argues that the life and individuality of Korean university could be only secured when it could have acquired the freedom and liberty as its pure form.
