교정시설 과밀수용 해소를 위한 전자감독에 관한 연구

전국 교정시설의 수용정원은 47,820명인데, 현재 54,744명이 수용되어 있으므로14% 과밀수용 되어 있는 상태이다. 이로 인해 수용자에 대한 인간의 존엄과 가치가훼손되고 있다. 과밀수용해소를 위해 교정시설을 건축하여 해결하는 것이 가장 근본적인 해결방법이지만 지역이기주의로 인해 신축하는 것은 쉽지가 않다. 따라서 교정시설을 신축하지 않으면서 과밀수용을 해결할 수 있는 방향으로 나아가야 한다. 그 방안으로 전자감독 조건부 가택구금을 실시하는 것이다. 전자감독은 두 가지 형태로 하는 것이다. 먼저 기결수용자에 대해서는 현행대로 위치추적장치를 발에 부착하는 형태로 하는 것이다. 다음으로 미결수용자에 대해서는 위치추적장치를 스마트워치 형태로 하여 손목에 착용하게 하거나 아예 몸속에 삽입시키는 베리칩으로 하는것이다. 전자감독 조건부 가택구금 대상자 중 먼저 발목에 부착하는 형태는 1년 미만의 단기수형자, 가석방자, 초고령수형자, 장애수형자 등으로 하여 조기 출소를 시키는 것이다. 다음으로 손목에 부착하는 형태는 미결수용자를 대상으로 전자감독 조건부 보석제도를 실시하는 것이다. 이를 통해 정당한 이유 없이 출석에 불응하거나 도주하는 경우에는 위치추적을 통해 조기에 검거하는 것이다. 만약 이러한 사실이 전자감독 조건부 보석자에게 발생할 경우 보증금 몰수는 물론 양형결정 시 참조하여 가중처벌 한다면 출석거부 및 도주를 예방할 수 있을 것이다. 실시에 따른 법률문제, 운영상문제, 비용문제, 피해자 및 국민정서문제 등 다양한문제점이 나타날 수 있다. 이러한 문제점을 최소화하기 위해서는 한 개의 교정시설을대상으로 실시한 후, 나타나는 문제점에 대한 충분한 보완을 한 다음, 전면적인 실시를 하면 될 것이다.
Abstract
The prison has 47,820 inmates, with 54,744 currently in custody, which is 14 percent more. This is undermining human dignity and values. The prison architecture for the elimination of overpopulation is the most fundamental solution. Howev er, due to r egional selfishness, i t is n ot easy to b uild a new prison. Therefore, the government should not build a new prison but move in the direction of solving overcrowding. The measure would allow a prisoner to live in his home after being released from prison on condition of electronic supervision. Electronic supervision is in two forms. First of all, for the inmates, a location tracking device is attached to the foot. Next, for undetermined inmates, global positioning system will be attached to the wrist through a smart watch. The receptor is a form of positioning device attached to the wrist through a smart watch. It is also done with a berry chip, a form that is inserted into the body at all. Among those subject to electronic supervision conditional house arrest, the first type attached to the ankle is short-term inmates, parolees, super-aged inmates, and handicapped inmates. Next, the electronic supervision conditional bail system will be implemented for undecided inmates. In this case, form of global positioning system is attached to the wrist. In this case, if they refuse to attend or flee without justifiable reasons, they will be arrested early through location tracking. If this fact is referred to in the form at trial, aggravated punishment will prevent rejection and flight. If implemented, various problems such as legal issues, operational problems, cost problems, and v ictims and people’s sentiments may appear. To minimize these problems, a single prison would need to fully compensate for the problems that arise after implementation and then implement them altogether.
