Abstract

The purpose of this research is to propose the direction to be dealt with interms of correction research, regarding ‘online community notification’, which openssex offender’s personal information to the public through a website, called sexoffender e-alimi, and ‘postal notification’, which forwards mail containing sexoffender’s personal information to a specific person in case of a sex offender beingresiding around one’s residence or facility, among many policies currently enforcedin our country to prevent sexual violence crime targeted at second-class citizenssuch as children, adolescents and women. For this, this researcher examined academic study trends related withcommunity notification gone out in the country from the time of introduction in2000 up to recently, and to compare with this, investigated what is not dealt within our country among academic researches presented in the US. First of all, in caseof academic research related with sex offender notification in Korea, it was foundthere are studies conducted on unconstitutionality in community notification, oncomparative law between the US Megan’s Law and our sex offender notification, onretroactivity associated with retroactive application of security measure, and recentlyon pointing out problems related with a severe punishment policy of sex offenders. In other words, many researches in our country were found to theoreticallyapproach regarding community notification, and research in empirical research juststayed in exploratory study including investigation of awareness It should be recognized that if the policies taken effect in a country targeted atcriminals are implemented only by national sentiment or legislators’ judgementwithout any consideration for those who are the policy target, this may havetemporary crime deterrent effect, but in the long view, it may come up againsteffectiveness or reliability. Therefore, this is a time for empirical study of whatcriminals and people around them think of this policy, how much effectivelawmakers and the general public consider it is through this policy, and lastly, whether criminals and their families didn’t experience collateral consequences dueto this or not. Collateral consequences mean that psychological, physical and socialdamage that sex offenders or their family suffer from notification, unlikecommunity protection effect or general and special prevention effect, at which sexoffender notification aimed at first. Actually, in America, these studies areconducted with various subjects, such as divorce or severance of family, difficultyin getting a job, physical harm, move, sense of isolation, and stress. Therefore, it isneeded for our country also to study this policy with a variety of subjects(forexample, perception of sex offender, judge, and sex crime victims, effectiveness ofsex offedner notification, and collateral consequences) not only conductingtheoretical study about sex offender notification any more.
