수형자 분류심사를 통한 합리적 처우방안에 관한 고찰

본 연구는 수형자 분류심사를 통한 합리적인 처우로 재범을 방지하고 사회복귀를 촉진할 수 있는 방안을 강구하는데 그 목적이 있다. 「형의 집행 및 수용자의 처우에 관한법률」은 다양한 분류심사를 통하여 개별처우를 하도록 규정하고 있고, 자세한 사항은동법 시행령 및 시행규칙, 분류처우업무지침 등에서 규율하고 있다. 현행의 수형자분류제도는 기본수용급, 경비처우급, 개별처우급으로 나누어지고, 현재 큰 의미를 가지는 것은 경비등급별 수용구분이라 할 수 있다. 즉 개방경비시설, 완화경비시설, 일반경비시설, 중(重)경비시설로 전국의 교정시설을 나누어 경비등급별로 수용하고 있는데, 현재 일반경비시설과 완화경비시설이 다수를 차지하고 있다. 현행 경비등급별 처우제도는 수용시설의 유사성, 전문인력 부족 등 여러 가지 문제점도 있으므로개선해 나갈 필요가 있다. 당면한 과밀수용 문제를 해소해 나가며 수형자 분류심사를 통하여 처우의 개별화 등합리적 처우방안을 마련하여 시행해 나가는 것이 필요한데, 이를 위해서는 부족한 전문인력 등을 보강할 수 있는 분류심사 및 인력의 전문화, 현재 한 개소만 운영되고 있는독립된 분류센터의 확대와 효율적 운영, 한국교정의 당면 과제 중 하나인 과밀수용 해소방안으로 분류심사 적극 활용, 경비등급별 수형자처우와 팀제근무의 연계시스템 구축, 교정재범예측지표(CO-REPI)의 효율적 활용 등이 그 방안이 될 수 있을 것이다. 나아가 처우의 개별화를 정착시켜 나가기 위해서는 「수형자 처우에 관한 UN최저기준 규칙」(만델라규칙)에서도 권고하듯이 수용인원이 500명 내외의 소규모 시설과 분류처우 전담인력, 시설확충 등이 제도적으로 뒷받침 되어야 하며, 수형자 분류심사 제도의 개선도 뒤 따라야 한다.
Abstract
The purpose of this study is to find ways to prevent recidivism by rational treatment through the screening of prisoners and to promote the return to society. The law 「Bill of the Penal Execution and Correctional Treatment Act」 requires individual treatment through various classification reviews. Details are regulated by the enforcement ordinance, enforcement regulations, and guidelines for classifying treatment. The current prisoner classification system is divided into basic accommodation class, guard treatment grade, and individual treatment grade. Now, it is the biggest meaning is guard treatment grade. Currently, there are a large number of general security facilities and mitigation security facilities, which are divided into open security facilities, mitigation security facilities, general security facilities, and the high security facilities. It is necessary to solve the problem of acceptance of overcrowding, and it is necessary to prepare reasonable treatment methods such as individualization of treatment through classification screening of prisoners. In order to do this, classification screening and specialization of manpower, expanding and efficient operation of the classification center which is currently operated by only one facility, active utilization of the classification examination as one of the problems of the Korean correction, which is one of the problems of overcrowding demand, establishing a linkage system between the treatment of the prisoners and team work. And the effective use of the Correctional Recidivism Prediction Index. Futhermore, to settle the individual of the treatment 「United Nations standard minimum rules for the Treatment of Prisoners」 (Mandela Rules), there should be systematic support for small-scale facilities with a capacity of around 500 people, dedicated personnel for classification treatment, and facilities expansion. It is necessary to improve the screening system for prisoners.
