개별처우 효과성 향상을 위한 분류심사 활용 방안 : 교정심리검사를 중심으로

교정정책의 궁극적인 목적은 출소 후 수형자의 성공적인 사회적응을 통한 재범방지에 있다. 그동안 우리나라 교정행정은 이러한 목적을 달성하기 위해 취업 친화적인 직업훈련을 개발․ 활성화하고 창업자금 지원제도 마련, 중간 처우의 집 운영 등과 같은 많은 새로운 제도를 도입하여 운영하고 있다. 그럼에도 불구하고 반인륜적이고 흉악한 범죄가 발생할 때마다 교정정책의 효율성은 여전히 논란의 중심이 되고 있다. 2008년 개정된 형의 집행 및 수용자의 처우에 관한 법률은 수형자의 사회복귀 도모를 목적으로 이를 위해 개별 처우를 수형자 처우의 기본원칙으로 명시하고 있다. 개별처우의 효율을 극대화하기 위해서는 수형자의 인성, 행동특성 및 자질 등을 과학적으로 조사․측정․평가하는 분류심사가 무엇보다 체계화되지 않으면 안 된다. 분류심사의 체계화는 객관적이고 합리적인 분류 지표 마련, 제도 운영에 필요한 전문인력 확보, 수용관리 및 처우와의 연계 및 활용 능력 등을 기반으로 한다. 대전지방교정청 산하 10개 기관을 대상으로 개별수형자의 범죄적 성향을 예측․관리하기 위한 교정심리검사 제도 운영 실태를 조사해 본 결과, 지정․해제 등 절차와 관련한 문제, 처우와의 연계 미흡, 심리특성을 치료하기 위한 사후 서비스 부족 등과 같은 문제점을 발견할 수 있었다. 목표지향적 접근을 통한 수형자 개별처우 효과를 극대화하기 위해서는 향후 분류검사에 임상심리사 등 전문가 활용을 제도적으로 확대하고 분류심사 평가 결과 및 처우 등 참고사항은 수용관리, 작업, 교육교화, 훈련 등 처우 각 분야에서 직접 참조․활용할 수 있도록 구체적인 실행용어로 기술되어야 한다. 왜냐하면 분류와 처우는 연속선상에 놓일 때 그 제도적 가치가 인정될 수 있기 때문이다.
Abstract
The ultimate goal of a correctional administration is crime prevention through successful reintegration after a criminal has been released. To achieve this goal the Korean Correctional Service has established job oriented vocational training programs, minor credit for opening own business, and half way house, etc. On the other hand, whenever serious crime happens in our society, people blame and doubt the efficiency of the correctional system. The new correctional law for the execution of sentence and treatment of inmates, which was enacted in 2008, focuses on “individual treatment” based on the needs of inmates to help them reintegrate into the community. To maximize the efficiency of “individual treatment”, we have to systematize the classification procedure in correctional administration. Because through the classification procedure we can investigate, measure and evaluate the inmate’s personality, character and quality. To systematize the classification procedure we need to establish an objective and rational classification index, recruit specialists who can run the classification program and link the program to other correctional management programs. In this paper, from a survey of 10 correctional institutions, under the Daejeon Regional Correctional Headquarters, about the real running situation of the correctional psychological test, I found some problems such as inmate designations and the lift of abnormal inmate status, lack of a mutual link with other treatment programs and aftercare, insufficient to treat the inmate’s abnormal character. To maximize an “individual treatment” efficiently in the future, we need to utilize more classification specialists in the classification procedure and write the results of the classification examination report in a more understandable and practical way so it can be referred to and utilized in other aspects of correctional management such as security management, vocational programs, rehabilitation and reintegration. Classification and inmate treatment can be efficient and useful only when those two are linked in practical correctional management.
