Abstract

As confronting the serious news for juvenile delinquency on the media, theopinion insisting severe punishment for juveniles are getting louder in oursociety. However, concerns for being criminalization of juveniles are arisingat the same time by scholars. The focal concern theory and classicaldeterrence theory of punishment are proper to provide the reasonabletheoretical background and phenomena of juvenile transfer. According to thefocal concern theory, the interest on blameworthiness, community protectionand practical implication of the sentencing of judges determines the weightsand the severity on punishment. The juvenile transfer is also part of thedecision. In other hand, the classical deterrence theory of punishment isunignorable theory for recidivism and crime prevention in terms of theseverity of the punishment. The purpose of this paper is to introduce and share the previous experience on juvenile criminalization throughout juvenile transfer(or waiver)in the US. Since the first juvenile court has been introduced in Illinois in1899, the diverse juvenile transfer laws were legislated in the US. As theresult, more juveniles became felonies than before, and the number ofjuveniles in adults prison increased consequently. The general forms ofjuvenile transfer are categorized into juvenile waiver by juvenile court, judiciary exclusion, and prosecution discretion. Although the detailedprocedures vary, all forms allow the juvenile transfer into the criminal courtultimately. However, the empirical researches proved very skeptical resultsfor the transfer system in terms of the deterrence effect. Many researchesreported that the transferred juveniles had higher rate of recidivism andcommitted the crime quicker than other counterpart. Moreover, theresearches pointed out that the juvenile justice system failed to follow thetransferred juveniles to evaluate the effectiveness in a long term perspective. Although the Korean juvenile transfer system is different on some points, theprevious experience of the U.S. juvenile transfer policy questions us for theeffectiveness of the get-tough approach for delinquent juveniles in Korea. Detailed policy implication will be discussed in the context.
