중국 청대 선당善堂·선회善会 자치제도의 거버넌스적 성격

이 논문은 과거의 자선 기구 가운데 주로 명말末明에 출현하여 청대淸代에 흥성한 민간 자선자치기구인 선당善堂과 선회善會에 대해 논의한다. 이 논문에서는 선당·선회의 형성 조건과 과정, 경영관리 제도 및 자산 조달과 운영 방식 등의 주요 내용이 무엇인지에 대해 살펴본다. 더불어 선당·선회 자치 과정에서의 거버넌스적 요소와 특징에 대해 아날학파적 시각에 따라 살펴본다. 청대에 흥기한 민간 자선 조직인 선당·선회는 인사 방면의 회강제, 윤치제, 동사제와 자산 조달과 운영제도 및 재무관리 방면의 신용조회제도 등을 포함한 완벽한 자치제도였다. 그러나 정부가 선당·선회 제도를 추진하면서 많은 선당·선회가 관료화된 조직으로 변해갔다. 그런데 한편으로 선당·선회의 자치제도가 국가에 영향을 미치기도 하였다. 주로 선당·선회의 규약과 《징신록》 등 자치 문건은 흔히 사법기관의 실제 재판의 주요 근거가 되었고, 《징신록》을 통해 구현된 공개원리도 점차 국가의 재정 제도와 기타 행정제도에 적용되었다.
Abstract
Charity associations and charity halls in Qing Dynasty had perfect autonomy system．It included administer system which developed from member managementrotation management to director managementand property running system and accounting system ．The autonomy system of charity association and charity hall and government affected each other．On the one handgovernments intervening made the autonomy space narrowedon the other handthe autonomy agreement of the charity association and charity hall became the important basis of judicial decision and the public principle used by the charity association and charity hall infiltrated the running of governments．
