Abstract
In determining the patent requirements for computerrelated inventions, the US approach is judicial exceptions are not eligible for patent. For the EPO approach, an invention is patent-eligible if there is use of hardwares in the claim, wherein a ‘non-technical feature’ is excluded at the stage of inventive step. In Korea, there are no legal principles which set non-technical features apart from technical features for inventive-step, while the patent-eligibility follows suit after the EPO approach. Namely, for the computer-related invention, a patent-eligibility hurdle is low and the inventive step plays a key part in deciding whether to grant patent or not. Therefore, there is necessity to analyze if our patent requirements are suitable for AI·IoT-related inventions, which incorporates non-technical features in many cases. This paper suggests 3-steps test, which has applied the EPO approach to our legal principles, on inventive step. To be more specific, the 3-steps test is to determine priorities of the factors which need to be considered on assessing patentrequirements. At a first step, hardwares should be extracted in the claim for the patent-eligibility decision. At a second step, the technical functions of the hardwares are separated and it is confirmed whether the technical functions are general-use or have more special technical features over general-use. At the last third step, it is assessed what the contribution of the non-technical feature and the effect of that contribution are, wherein the non-technical feature have not been considered at the second step. First of all, it is assessed whether there is technical contribution of the non-technical feature. That is to say, it is analyzed what the non-technical feature contributes to the technical feature in the claim, like a physical aid. And then, it is decided whether the physical aid is a meaningful technical factor. At this point, a conclusion is drawn that mutual cooperation by close combination can be acknowledged if a physical aid is caused in ‘technical feature’ by ‘non-technical feature’ and its technical effect. The 3-steps test differs from the Comvik approach of EPO in that the former extracts specific technical feature while the latter excludes the non-technical feature on inventive step. Moreover, the 3-steps test has such significance in that the test assesses inventive step by comparison with prior art documents based on technical feature only and confirms close combination by distinguishing technical feature fromnon-technical feature, by the contribution of non-technical feature to technical feature and the effect considered, wherein the non-technical feature have been excluded by the priority.
