Abstract

The general SW invention means that means or steps for solving a certain purpose are realized in an algorithm form. Meanwhile as to the AI invention, the algorithm is not realized by deciding the optimum purpose what to do but means or steps deriving the optimum purpose are realized in an algorithm by reproducing human neural network, studying and deciding by themselves. Elements of the AI invention are the source data, the learning data structure, the pre-learning parameter, the deep learning and the program for learning, the learning completion model, the post-learning parameter, the inference program, the applied input data, the product, and the hardware coupling etc., and means and steps for realizing them are described in an algorithm form. Among elements thereof there are many cases where non-technical elements of data themselves, men's artificial behaviors, general purpose computer technologies etc. are included or combined. Such a non-technical element may be described in claims for concretely explaining means or steps realizing the AI invention, but if deciding the inventiveness, it is important whether to compare the whole including such a non-technical element to the prior art or to compare by excluding such a non-technical element, and it has been reviewed with respect thereto by comparison. The inventiveness is decided as a whole to include non-technical elements in US and Japan otherwise the inventiveness is decided as only technological elements excluding non-technical elements in Europe. It seems that there is no precedents concretely executing judgement criteria thereon in Korea and accordingly it is needed to establish the criteria deciding the inventiveness as a whole by combining non-technical elements and technological elements from applying legal principles in that the inventiveness should be decided as a whole by organically combining each element of invention suggesting in the Supreme Court Judgement at working level.
