Abstract
As the content industry-such as games and animation-continues to grow, the proportion of works created within organizations as works made for hire is also increasing. However, the current Copyright Act in Korea remains insufficient in protecting employee-creators. This article examines the structural issues of the current system and explores possible improvements by analyzing the legislative backgrounds of major countries’ systems governing works made for hire, with particular focus on Japan, whose system served as a model for Korea. Compared to the employee invention system, a notable gap in creator protection persists. To address this, it is not enough to introduce statutory compensation provisions alone; policy support is essential to foster a corporate culture of voluntary compensation. Ultimately, the legal framework should be improved to reflect the complex demands of our time-protecting creators’ moral rights, ensuring legal stability in the distribution of works, and securing fair compensation for employers' economic contributions.
