Abstract
As artificial intelligence(AI) technologies rapidly advance, "AI cover songs"—music content that mimics the voice of specific singers using AI—are proliferating across open platforms such as YouTube. This phenomenon has raised complex issues involving infringement of copyrights, performers’ rights, phonogram producers’ rights, and publicity rights. These AI-generated songs are often produced and distributed without authorization from the original creators, infringing upon their rights. Moreover, unlike conventional music services, such content is disseminated through platform environments where protective mechanisms—such as copyright verification procedures or prior approval systems—are largely absent, thereby exacerbating the protection gap. Rights holders face significant challenges in practice, including difficulty in proving infringement, inefficiency in legal remedies, and technical limitations in identifying unauthorized uses. This study defines the concept of AI cover songs, analyzes their production and distribution practices, and examines the recent surge of AI cover content on major platforms such as YouTube. It then conducts an in-depth legal analysis of key issues arising under copyright law, neighboring rights—specifically those of performers and phonogram producers—as well as publicity rights under Korea’s Unfair Competition Prevention Act. The study further highlights the practical and technological limitations in rights enforcement across different stakeholder groups and proposes feasible solutions. In particular, it emphasizes the need for stronger platform accountability, enhanced technical and policy frameworks, and a multifaceted legislative and institutional response. Ultimately, the study underscores the importance of establishing cooperative governance among rights holders, platforms, users, and technology developers in order to balance innovation in AI with the protection of creators’ rights.
