Abstract
A Study on the Development of Chinese Civil Laws in view of Legal History Lee, Jong Khil This study aims to understand the development of Chinese Civil Laws in Chinese legal history. Almost all kinds of law were mingled in ancient China. At that times, laws were in existence, but there was not the concept of individual law, especially ancient times and premodern society in Chinese history. In this study, Civil Laws imply relations of property and social position of private persons. I investigate the growing process of Chinese Civil Laws under the premodern society of China, to Qing(淸) dynasty. In this treatise, Civil Laws comprise contents as follow : for instance, the ownership of real estate and movable property, contract, intermarriage and succession in family relations, civil suit, and so on. The periodization of Chinese legal history in this study is divided according to the development degree of Civil Laws. And then ancient Chinese Civil Laws in history are generally demarcated as three ages : ①ancient society of slavery centering around XiZhou(西周) dynasty ②establishment era of ancient Chinese Civil Laws to Sui(隋) Tang(唐) dynasty ③development phase of those to Ming(明) Qing(淸) dynasty. Especially I intend to study this thesis with the exception of the late period of Qing, for many scholars of law maintain the modernization on the Chinese Civil Laws with lively argument at that times. Therefore the research of Chinese Civil Laws after the late period of Qing is asked for a separate treatise. This study verifies that Civil Laws had pursued the growth of private rights and the diversity of those through the codification in Chinese legal history.
