지방자치는 ‘민주주의 학교’라 한다. 지방자치를 통해 민주주의를 훈련하고 학습할 기회를 갖는다는 의미이다. 특히, 주민조례발안 제도는 지역의 주민으로서 직접 지역에 필요한 조례의 제정․개정․폐지를 청구하는 제도로서 2021년 제정된「주민조례발안에 관한 법률」에 근거한다. 본 글은 청소년 정치참여교육으로서 주민조례발안제도를 활용한 모의입법 교육의 가능성을 검토하였다. 논의 내용은 다음과 같다. 첫째, 주민조례발안제도 현황 검토를 통해 모의입법 교육의 가능성을 살펴보았다. 둘째, 청소년 모의 주민조례발안 가능성 검토로서 모의 주민조례발안의 의미와 방법, 교육적 의의에 대해 논의하였다. 그리고 제도적 과제로 입법자문관 제도를 통한 청소년의 모의입법 활동 지원과 「학교민주시민교육조례」, 「참정권교육 활성화에 관한 조례」를 정비하여 실질적인 정치참여교육 기능 강화를 강조하였다. 마지막으로, 이상 논의 내용에 근거하여 주민조례발안제도를 활용한 모의입법 교육의 가능성을 정리하였다. 청소년 모의 주민조례발안 제도를 통해 민주주의의 학교로서의 지방자치 기능의 활성화를 기대한다.
Abstract
Local self-government is often referred to as a "school of democracy." This implies that it provides opportunities to practice and learn democracy through participation in local governance. In particular, the Resident Ordinance Initiative System allows local residents to directly propose the enactment, amendment, or repeal of ordinances necessary for their community. This system is based on the Resident Ordinance Initiative Act, which was enacted in 2021. This article examines the potential of mock legislative education utilizing the Resident Ordinance Initiative System as a means of political participation education for youth. The discussion is structured as follows. First, the potential of mock legislative education was examined through a review of the current status of the Resident Ordinance Initiative System. Second, the feasibility of a Youth Mock Resident Ordinance Initiative was explored by discussing its meaning and methods, educational significance, and institutional challenges. Finally, based on the above discussions, the study concludes by highlighting the advantages of mock legislative education utilizing the Resident Ordinance Initiative System. It is expected that the Mock Resident Ordinance Initiative will contribute to revitalizing the role of local self-government as a school of democracy.
