북한의 지리적표시제와 남북 제도 조화방안 연구

본 논문에서는 북한 내 GI 운영과 관리 현황을 고찰하여 남북의 GI 비교 및 조화방안을 제시하였다. 북한은 세계지식재산권기구(WIPO) 리스본협약에 6개 GI 상품(개성고려인삼, 백두산 가시오갈피, 고려신덕산샘물, 강서약수, 백두산들쭉술 그리고 평양랭면)을 등록하였다. 향후 북한이 개혁·개방을 시행할 때 전통상품과 농업을 보호하기 위해 GI의 제도적 정립 및 관련 상품의 등록이 필요하다. 이외에도 본 논문에서는 북한이 향후 GI 등록을 예상할 수 있는 유력 상품으로 WIPO 마드리드협약 내 상표 등록되어 있는 대동강맥주 및 금강산 샘물에 대해 고찰하였다. GI 영역에서의 남북한 쟁점 사안은 다음과 같다. 본 논문에서는 첫째, 고려인삼 제품에 대한 남북의 이해 차이, 둘째, 김치에 관한 GI 등록문제, 셋째, ‘백두산’ 상품명 표기에 관한 남·북과 중국의 이해관계를 제시한다. 정치적․안보적 위기상황이 해제된 이후 북한이 개혁·개방에 본격적으로 나서기 전, 남북한 간 GI 하 문제점들을 해결하고, 이후 통일 법제화 과정을 준비하기 위해 국제조약에서의 조화과정을 거칠 필요가 있다. 나아가 남북경협을 고려하여 개성공단을 한국의 FTA에서 역외가공지역(OPZ)으로 예외적 원산지 규정을 두었던 것과 마찬가지로, 향후 남북협력을 통해 한국이 추진하는 FTA 및 WIPO에서 GI 남북한 표준을 마련해야 할 것이다.
Abstract
This study analyzes the status of GI operations and management in North Korea. This paper presented a comparison and the Harmonized System plan of GI between North and South Korea. North Korea registered six GI products(Kaesong-Koryo-Insam, Paektusan Kasiogalpi, Koryo Sindoksan Saemmul, Kangso Yaksu, Paektusan Tuljiksul, and PyongYang Raengmyon) under the Lisbon Agreement of World Intellectual Property Organization (WIPO). In addition, this paper examined the Taedonggang Beer and Kumgangsan Saemmul registered as the most promising products for North Korea to expect GI registration in the future. The issues in the GI area between North and South Korea are as follows. First, the differences between South and North Korea's understanding of Koryo-Insam products, second, the GI registration problem for kimchi, and third, the interests of South and North Korea and China regarding the labeling of 'Paekdusan' are presented. After the political and security crisis has been lifted, when North Korea begins to reform and open in full swing, it is necessary to resolve GI problems between the two Koreas. Thereafter, the South and North Koreas have to go through a harmonization process in international treaties to prepare for the process of unification and legalization. Korea has set an exceptional origin regulation for the Kaesong Industrial Complex within Korea's FTA to the Outward Processing Zone (OPZ) considering inter-Korean economic cooperation. Likewise, the Korean government should establish the GI inter-Korean standards in the FTA and WIPO promoted by Korea through inter-Korean cooperation in the future.
