최근 국제시장에서 우리 기업들이 선진국 기업들과 지식재산권, 특히 특허 관련 분쟁에 휘말리는 일이 빈번해지고, 분쟁 과정에서 거액의 손해배상이나 높은 기술료 지불이 결정되는 사례가 증가하고 있다. 본 논문은 이러한 상황에 대처하기 위해 기업뿐만 아니라 국가적 차원에서도 분쟁에 대응할 체계적 구조를 가져야 한다는 방향성에 따라, 국가의 대응체계 구성을 위한 과제를 도출하는데 목적을 두었다. 그래서 본 논문에서는, 먼저 지식재산권 분쟁 발생 배경과 구조, 실태 등을 분석하고, 주요 국가의 지식재산권 침해에 관한 법제도적 현황을 살펴보았다. 그리고 이에 대응하기 위한 국가적 과제로 국가별 지식재산권 관련 제도 및 기술에 대한 중소기업 교육, 정보교환 인프라 구축, 자체기술개발에 대한 지원 확대, 중소기업의 해외 특허 취득 등의 적극 지원 등을 제시하였다.
Abstract
This paper investigated the background & structure of intellectual property disputes and the main national legislation of U.S., Japan, China, South Korea. And a case study in Intellectual property disputes. This Research suggest that, international intellectual property issues related to national institutions and technology education for the small and medium-sized enterprises. And were presented with create an information exchange infrastructure and other ideas.
