대외정책결정의 견제자로서의 의회: 자유무역협정(FTA) 체결과정에서 미국 의회의 역할을 중심으로

대외정책과 국내정치 간의 연계는 이제 더 이상 새로운 사실이 아니며, 대내정책과 마찬가지로 대외정책에 있어서도 대표성과 책임성이 중요하게 대두되고 있다. 이 글은 대외정책에서 우리 국회가 어떠한 역할을 수행할 수 있는지 살펴보기 위해 자유무역협정 체결과정에서 미국 의회의 영향력을 검토해 보았다. 논의의 결과, 미국 의회는 “신속처리절차”를 통해 행정부의 효율적인 협상 추진을 뒷받침하였지만, 그 과정 전반에 걸쳐 행정부의 감시할 수 있는 일련의 제도적 수단들을 동시에 마련함으로써 견제기관으로서의 역할을 충실히 하고 있는 것으로 나타났다. 이러한 제도적 장치들은 미국의 의회가 협상의 결과물에 대한 최종적인 심의⋅비준권한 이외에도 자유무역협정 체결과정 전반에 영향력을 발휘할 수 있는 수단을 제공함으로써, 의회가 협상을 둘러싼 국내의 갈등을 사전에 조정할 수 있는 충분한 기회를 확보하고 궁극적으로는 협정으로 인해 파생될 수 있는 사회적 비용을 최소화하는데 기여하였다. 미국 의회처럼 우리 국회도 협정의 진행과정에서 감시⋅견제에 필요한 정보를 제도적으로 확보한다면 지금처럼 심의⋅비준과정에서 수반되는 사회적 비용을 크게 줄일 수 있을 뿐 아니라 국내적 갈등을 완화하는 데에도 기여할 수 있을 것이다.
Abstract
Nowadays, the linkages between foreign policy and domestic policy have become obvious, which implies that we should consider representation and responsibility in decision-making process of foreign policy. This paper examines the role and influence of US Congress in the process of US FTAs. Even under the "Fast Track Procedures," which helps the executive branch proceed negotiation efficiently, US Congress is capable to engage in the process of negotiation with its institutional power of check and balance, not just the final outcome of FTAs. Thanks to the institutional power, US Congress could provide chances to coordinate the conflicts of interests during the decision-making process. It suggests that, in the decision-making of foreign policy, institutional power for Korean national assembly be necessary to alleviate potential conflicts between domestic groups.
