Abstract

This study examines the relationship between the editorial control of the Internet Service Providers(ISP) and liabilities for third party contents. By analysing the common law framework of the ISP liability that classifies ISPs as a publisher, distributor, or common carrier depending on the amount of editorial control over defamatory material, cases that applied this common law framework, the “Good Samaritan” provision of the Communications Decency Act(CDA) that provides blanket immunity to ISPs, and post-CDA cases that interpreted CDA’s immunity, and recent arguments regarding ISP liabilities, the logical relationship between the editorial control and liability of ISPs is manifested. It is found that the ISP liability rules and arguments in the US are governed by the “self-regulation” regime that focuses on preventive, policy implications rather than on the remedial justice of the particular cases. In the recent “suicide-homepage” case in Korea, the editorial control and monitoring efforts were considered to be an important factor that leads to the liability of ISPs. The court in Korea regards ISPs' editorial control and efforts as a reason to hold ISPs accountable on one hand, and then holds ISPs accountable due to the lack of the editorial efforts on the other hand. The sentiment that the ISPs should not only be legally liable but also be “socially responsible” seems to be implied in the decision, and the court fails to provide sufficiently specific, predictable guidelines for ISPs to follow to be immune from liability. This study suggests that liabilities rules should be based on the “conduct” rather than the result of ISPs' editorial efforts.
