Abstract
This article examines the contradictory nature of Japan’s sovereignty claims over Dokdo. Japan’s position rests on two mutually incompatible claims: on the one hand, that Japan lawfully acquired Dokdo in 1905 by occupying it as terra nullius; on the other hand, that Dokdo constitutes Japan’s inherent territory. The inconsistencies that have been apparent since the early stages of the post-1952 Korea–Japan exchange of diplomatic notes on Dokdo call for a closer examination of the legal meaning and substantive nature of Japan’s 1905 Cabinet Decision concerning Dokdo. This article identifies three key points. First, it is highly likely that Japan incorporated Dokdo through an act of occupation in the 1905 Cabinet Decision. Second, Japan was likely aware around the time of the incorporation that Dokdo was not terra nullius or at least that its status as a subject of occupation was open to dispute. Third, Japan has strategic incentives to articulate its claims on the basis of inherent territory rather than terra nullius occupation. These three points provide a basis for tracing the contradictions in Japan’s claims and for further developing scholarly discussion on the issue.
