Abstract
This study examines the legal framework and regulatory interpretation issues regarding credit information of sole proprietors by analyzing the scope of application and interpretative conflicts between the current Personal Information Protection Act and the Credit Information Act. Since sole proprietors hold dual status as both natural persons and business entities, ambiguities arise in the application of relevant laws and regulations. Through analyzing differences in regulatory interpretations among institutions related to sole proprietor credit information, this research confirmed that sole proprietor information is interpreted as either personal credit information or corporate credit information depending on circumstances, causing disputes between data processors and data subjects. The main considerations identified are ambiguity in interpretation due to the lack of clear criteria for legal distinction and insufficient consistency in the concept of corporate credit information under current regulations. This study highlights the necessity for legislative and policy improvements to ensure systematic consistency among relevant laws and regulations, and is expected to contribute to reducing complaints and legal disputes through establishing clear regulatory guidelines in the future.
