Abstract
This article aims to analyze the 'Russo-Ukraine War' using the conceptual tool of 'preventive war'. To do so, I will explain whether or not Russo-Ukraine War is justified by reviewing how preventive war is defined in international law and what examples there are from history. As an additional research outcome, I will try to predict the impact of this war on the international order. There is no disputing that Russia's invasion of Ukraine, a preventive war, is a clear violation of international law. While all wars involve humanitarian catastrophe, unavoidable wars can be justified when they are consistent with international law. However, preventive wars lose their political legitimacy as well as their international legal recognition upon initiation. In addition, the preventive wars that invoke the balance of power as a casus belli, are hard to justify under the theory of bellum justum.
