정치적 자유의 공화주의적 출구 - 아렌트, 페팃, 루소의 자유론을 중심으로

필자는 이 글에서 아렌트, 페팃, 루소의 자유론이 벌린식 자유주의적 자유론의 대안이 될 수 있는지를 탐색하고자 한다. 아렌트의 자유론은 자유는 사적 영역의 속성이 아니라고 주장한다는 점에서, 벌린의 자유론과 가장 극명히 대비되는 공화주의적 자유론의 한 전형이다. 로마 공화정의 자유론을 계승하여 자유를 비지배로 정의하는 페팃은 벌린과 달리 자유는 소극적인 것도, 적극적인 것도 아니라는 입장을 취하고 있으며, 아렌트와도 달리 자유는 사적, 공적 영역의 구분과 무관하게 모든 영역에 적용될 수 있는 것이라고 주장한다는 점에서 공화주의적 자유의 또 다른 가능성을 보여주고 있다. 이러한 아렌트와 페팃의 자유론은 각각 소극적 자유의 보전 이상의 것으로서 정치적 자유의 독자적 의미와 기능을 명료히 밝혔다는 점에서, 그리고 자유의 개념과 적용 범위가 공적 영역이나 사적 영역 중 어느 한 곳의 문제가 아니라는 것을 분명히 드러냈다는 점에서 높이 평가할 수 있지만 각각 나름의 한계를 갖고 있는 것도 사실이다. 그런 면에서 필자가 가장 합당한 것으로 생각하는 공화주의적 자유론은 그것의 절차주의적 변용을 허용한다는 전제 하에서 일반 의지로 대표되는 루소의 자유론이다.
Abstract
Berlin’s liberty theory gets a favorable response, since it theoretically changes the main issue of political liberty from the legitimacy of rule to the area of non-interference. However, it cannot avoid criticism that the negative liberty conflicts with the contemporary ideal of welfare state. Furthermore, it makes the idea of political liberty meaningless. Recently, even some liberals join to criticize Berlin’s liberty theory. However, the liberal critics tacitly share the same wrong premise with Berlin. Both of them deal with political liberty as built-in. Political liberty is, for liberals, not the property of political action itsel but the result of political action. Against this line of criticism, I try to examine three republicanist potentials in this article. First, H. Arendt exhibits a typical republican concept of political liberty by defining political liberty as public one. Second, P. Pettit proposes another republican concept of political liberty as non-domination. Arendt’s concept of political liberty can be prized, since she partly succeeds to defend a public meaning of political liberty against negative liberty. Pettit’s liberty also has a good point, in that it encompasses all domains of political liberty. However, I finally recommend Rousseau’s conception of political liberty as the most feasible republicanist alternative.
