영국의 아동 성범죄 피해자 진술의 영상녹화물에 대한 공판 전 반대신문 제도에 관한 고찰 - 아동 성범죄 재판에서의 증거보전절차 활용에 관한 시사점을 중심으로

본 논문에서는 영국의 아동증거법 중에서도 특히 우리의 증거보전절차와 나름대로 유사하다고 할 수 있는 제28조의 도입 및 그 시행에 이르기까지의 논의, 그리고 시행 이후의 평가에 대하여 상세히 살펴보았다. 아동증거법 제28조는 영국의 형사절차가 당사자주의의 유구한 전통을 폐기하지 않으면서도 아동·청소년 증인 진술의 특성과 아동·청소년의 최선의 이익을 고려하여 보다 나은 증거 조사 방법을 모색해 나가는 과정에서 등장하였다. 이에 당사자주의와 직권주의를 혼용하는 가운데 대법원과 헌법재판소 모두 당사자주의적 요소를 점차 강화하고자 하는 흐름을 보여주는 우리 형사절차를 아동·청소년 증인에게 적합하게 재구성하는 데에 있어서 참고할 가치가 크다. 순수 당사자주의 전통을 따르는 국가에서 활용하고 있는 조치라면, 당사자주의의 ‘본질’에 맞지 않다는 점을 피고인 측의 제약 없는 반대신문권 행사의 근거로 내세우는 것의 설득력은 상당 부분 반감될 것이고, 다른 한편으로 아동·청소년의 이익을 최선으로 고려하더라도 당사자주의를 통한 공정한 재판 확보를 지향점으로 삼는 이상 넘을 수 없는 한계점이 무엇인지에 대하여도 착안점을 제공할 수 있기 때문이다. 영국의 아동증거법 제28조의 시행을 둘러싼 여러 논쟁은, 우리가 피고인의 반대신문권을 공정한 재판을 받을 권리 보장을 위한 핵심 수단으로 파악하는 이상 공소제기 전에 질문 기회를 부여하는 것을 통해 위 권리를 실현하는 데에는 한계가 있다는 점을 보여준다. 이에 본 논문에서는 공소제기 전 증거보전 절차는 피고인의 반대신문권 제약이 크지 않거나 증인의 기억력이 급격히 소실되는 등의 사정이 명백하게 존재하는 경우 등에 한정하여서만 활용할 수 있고, 절차 활용을 위해 몇 가지 제도 개선이 추가적으로 필요함을 주장하였다. 한편 공소제기 후에는 증거보전 절차를 활용하기보다는 신속한 공판기일 개시에 초점을 맞추는 것이 더 효율적인 방안이라고 보았다.
Abstract
In this paper, we thoroughly examine the discussions leading up to the introduction and implementation of Section 28 of The Youth Justice and Criminal Evidence Act(“YJCEA”) of England & Wales, which can be considered particularly similar to our evidentiary preservation procedures within the context of sexual offences against children. Section 28 of the YJCEA emerged as part of the process of seeking better methods of evidentiary proceedings that take into account the characteristics of testimony from child witnesses, as well as the best interests of children, without completely abandoning the longstanding tradition of adversarial proceedings. Therefore, in the Korean context where both adversarial and inquisitorial elements are blended and the trend within our criminal procedure system, as demonstrated by both the Supreme Court and the Constitutional Court, is moving to reinforce adversarial elements more than before, its significant relevance in the appropriate reconstruction of our criminal procedure system for child witnesses is worth enough to highlight. Various debates surrounding the implementation of Section 28 demonstrate that if we consider ensuring the defendant's right to cross-examination as a core means of guaranteeing the right to fair trial, significant limitations may arise from providing questioning opportunities prior to indictment. Therefore, this paper argues that pre-indictment evidentiary preservation procedures should be limited to cases where circumstances such as rapid deterioration of the witness's memory are clearly present, and further institutional improvements are necessary for the utilization of such procedures. On the other hand, it is seen as more efficient to focus on expediting the commencement of trial proceedings rather than utilizing evidentiary preservation procedures after indictment.
