특허분쟁으로 무효화된 특허의 특징 ―우리나라의 무효심판 자료에 대한 실증분석

2001년∼2017년 기간 동안 국내 특허심판원에 무효심판이 한번 이상 청구된 6,367건의 특허를 대상으로 법적·행정적 판단과 특허권자의 의사결정을 함께 고려할 수 있는 다항로짓모형을 설정한 후 특허권의 유·무효에 영향을 미치는 속성에 대하여 분석하였다. 영향을 미치는 속성들은 특허권유·무효 유형 간에 상이함을 실증분석을 통해 확인하였다. 전체 특허를 대상으로 분석한 결과에 따르면, 특허의 청구항의 수와 인용한 특허의 수는 특허권 만료 및 유지가 될 확률을 높이는 것으로 나타났다. 즉, 특허의 경제적 가치가 높을수록 특허 소송에 연루되더라도 특허권자가특허권을 보호하는 것으로 나타났다. 반면, 특허의 신규성과 특허권자의 소송 대항력에 관련한 특허의 속성은 법적·행정적 판단에 의해 무효가 될 확률을 높이는 것으로 나타났다. 전체 표본 중 출원인이 기업인 표본으로 한정하여 분석한 결과에서는, 특허의 전략적 가치에 관련한 특허의 속성이 특허권의 유·무효에 미치는 영향이 더 확연하게 나타났다. 특히 특허의 고유한 전략적 가치를 대변하는 피인용한 특허의 수는 통계적 유의성을 상실하는 반면 기업의 기술 경쟁 우위 측면에서 전략적 가치를 대변하는 자기 특허 인용한 특허의 수가 특허권 유·무효에 아주 유의하게 작용하는 것으로나타났다.
Abstract
We study factors affecting the validity/invalidity judgement of a patent involved in invalidation litigation, using the data set of 6,367 patents involved in invalidation trials from 2001 to 2017. We estimate the multinomial logit model by separating invalidity into invalidity by legal/administrative judgement and invalidity by the patent holder’s decision. We find structural heterogeneity between two types of invalidity judgements in factors affecting validity/invalidity status. Most importantly, we find that factors related to the novelty and the defensive power in the lawsuit affect positively the probability of invalidity by legal/administrative judgement whereas factors related to the patent’s strategic stake affect negatively the probability of invalidity by the patent holder’s decision. Our study indicates that patent’s economic value and patent’s strategic stake are key aspects in determining the validity/invalidity judgement of a patent when it is involved in the invalidation litigation, and that the strategic stake is an important aspect for the patent holder to decide on participation in (or continuation of) legal dispute. The role played by the strategic stake is especially conspicuous in the analysis of patents whose patentees are firms.
