특허 분쟁의 결정요인에 대한 연구 : 한국의 미국 특허 분쟁 정보를 활용한 분석

본 논문에서는 특허 분쟁의 결정요인을 파악하기 위해 전미경제연구소의 미국 특허 자료와 LITALERT 데이터베이스의 특허 분쟁 자료를 통합하여, 한국의 미국 특허에 대해 특허 출원 기업 및 개별 특허의 특성과 특허가 속한 기술영역이 분쟁 연루에 미치는 영향을 분석하였다. 분석 결과 (1) 특허 수준에서 분석 할 경우 출원 기업의 규모가 클수록 특허 분쟁에 덜 연루되고, (2) 많은 선행연구에 기반한 응용혁신이면서 광범위한 권리범위를 갖고 있는 기술경제적 가치가 중간 수준인 특허가 주로 분쟁 대상이 되며, (3) 화학 및 기계영역과 비교하여 컴퓨터/통신, 전기/전자 및 기타영역의 특허가 더 분쟁에 연루되는 것으로 나타났다. 또한, 컴퓨터/통신기술의 경우 특허의 인용·피인용 수준 및 독창성이 특허 분쟁의 결정요인인 반면, 전기/전자기술의 경우 기업의 규모와 일반성이 특허 분쟁의 결정요인으로 기술영역에 따라 특허 분쟁 결정요인에 차이가 있음을 발견 할 수 있었다. 본 연구는 한국의 미국 특허 분쟁에 대한 통계적·계량경제학적 접근을 취한 선구적인 국내 연구로 그 의의를 갖고 있다.
Abstract
This paper investigated the effects of firm, patent, and technology field on the patent dispute of by analyzing Korea's US patent disputes. This study found that (1) larger firms are less likely to be involved in patent disputes than small firms; (2) patents with more backward citation and claims are more likely to be involved in patent disputes, and patents with medium level of forward citation are more likely to be involved in patent disputes; (3) patent in Computer/Communication and Electrical/Electronic fields are more likely involved in patent disputes than the patents in Chemical and Pharmaceutical/Medical fields. In addition, citation Computer/Communication field, while Electrical/Electronic field.
