국방 지식재산권 창출·활용을 위한 연구: 국유특허와 비무기체계 업체투자연구개발을 중심으로

국방과학기술과 관련하여 이를 적극적으로 보호하기 위해서 방위사업법, 과학기술기본법, 국방과학연구소법 등의 많은 법률과 규정이 구비되어 있다. 이러한 제도적 장치와 더불어 군에서도 국방과학기술의 지식재산권에 대한 관심과 노력을 증대시키고 있으나 일반기업과 비교하여 아직 초기 단계에 머물고 있는 실정이다. 이에 본 글에서는 군에서 발생할 수 있는 국방발명의 종류와 각 군의 특허권현황에 대해서 살펴봤으며, 지식재산권과 관련하여 군에서 문제될 수 있는 사항과이에 대한 개선사항들을 논의하였다. 특히 직무발명과 관련하여 생산시설이 없는군이 어떠한 방식으로 자신들이 발명한 직무발명을 활용할 수 있는지에 대하여 사례와 함께 설명하였으며, 이에 대한 해결책으로 일기관 범위의 인정, 실시요건 및발명자 보상에 대한 법규 개정을 제안하였다. 또한, 상대적으로 관심이 적은 비무기체계사업 분야에서 업체투자연구개발시 발생할 수 있는 지식재산권 소유 문제와 이에 대한 해결방안을 제시하였다.
Abstract
There are many laws and regulations such as Defense AcquisitionProgram Act, Framework Act on Science and Technology, Act on theAgency for Defense Development in order to actively protect defensescience and technology. Along with the institutional strategy, themilitary are increasing a interest and an effort about intellectual propertyrights of defense science and technology. However, they are at an earlystage in compared with other commercial companies. In this study, I examined a wide variety of the defense inventionthat may occur in the military and patents which the military arepossessing. Additionally, I reviewed problems which are related tointellectual property rights and improvements on that. Particularly, thisstudy discusses inventions which people who worked in the militaryinvented and how the military which don’t have manufacturing facilitiescan utilize these inventions. It also concludes problems on who hasintellectual property rights when private companies research non-lethalweapon systems and offers rational solutions on it.
