FTA에서 유전자원 및 관련 전통지식의 지식재산권적 보호방안에 관한 연구

유전자원 및 관련 전통지식 그 자체는 지식재산권의 보호 대상이 아니다. 그러나 지식재산권은 유전자원 및 관련 전통지식의 이용으로부터 발생하는 이익의 공정하고 공평한 공유를 위한 주요 수단으로 활용될 수 있다. 즉 유전자원 및 관련 전통지식은 특허, 지리적 표시와 같은 지식재산권을 통하여 보호될 수 있다. 이처럼 지식재산권을 통한 유전자원 및 관련 전통지식 보호방안은 FTA에서도 주요 협상 쟁점으로 논의되고 있다. 예컨대 미국이 체결한 FTA에서는 생물다양성 관련 TRIPs-plus 규정이 마련되었다. 즉 미국의 기 체결 FTA에서는 생물체에 대한 특허대상을 확대하고, 1991년 UPOV 협약에의 가입을 강제하고 있다. 이러한 TRIPs-plus 규정들은 향후 다자간 통상조약에서의 합의 도출에도 영향을 끼칠 것이다. 한편 개도국과의 FTA에서는 유전자원 및 관련 전통지식의 출처공개의무화 여부가 논의되고 있다. 우리나라는 유전자원 이용국으로서 지금까지는 유전자원 제공국들과의 FTA에서 무난한 협상을 이끌어 냈다. 그러나 지금은 나고야의정서가 발효했고, 많은 국가들이 당사국으로 가입한 만큼 향후 개도국과의 FTA에서 나고야의정서의 구체적인 요건 및 출처공개요건의 의무화를 두고 협상이 치열해질 것인바 국익에 부합한 협상 전략이 필요하다.
Abstract
Genetic resources and traditional knowledge associated with genetic resources themselves can not be protected by intellectual property rights. Intellectual property rights, however, can be used as a tool for fair and equitable benefit-sharing. Namely, genetic resources and traditional knowledge associated with genetic resources can be protected by intellectual property rights such as patents and geological indications. Recently, the ways of protection of genetic resources and traditional knowledge associated with genetic resources through intellectual property rights are also discussed in FTAs. For example, TRIPs-plus provisions related to biodiversity are discussed in FTAs concluded with United Stares of America(USA). Those USA FTAs enlarge patentability of life forms and demand FTA parties to ratify 1991 version UPOV. These TRIPs-plus provisions will affect multilateral trade agreements in the future. Meanwhile, FTAs with developing countries discuss disclosure requirements of inventions based on genetic resources and traditional knowledge associated with genetic resources. Until now, Korea as a user country of genetic resources has negotiated appropriate provisions related to biodiversity. But now it is time to have strategy in FTAs to discuss specific requirements and disclosure requirements because Nagoya protocol came into force.
