2000년대 초부터는 자유무역협정에서도 생물다양성과 전통지식관련 조항이 포함되는 새로운 경향이 나타나고 있다는 것이다. 특히 2010년 10월 나고야의정서가 채택된 이후에 협상 또는 타결되고 있는 FTA에서는 나고야의정서의 주요 요건이 구체적으로 언급되고 있다. 그 중에서도 중국이 체결한 FTA에서는 TRIPS에서 논의되고 있는 개도국의 입장이 그대로 반영되고 있다는 점이 특징적이다. 이처럼 유전자원과 전통지식이 통상협정에서도 중요한 협상의제가 되고 있는 가운데 우리 정부는 개도국의 입장을 대변하고 있는 중국과 FTA를 체결하였다. 나고야의정서의 채택을 전후하여 중국정부가 유전자원과 전통지식에 대한 보호를 강화하고 있어 이와 같은 중국정부의 입장이 한-중 FTA에서 어떻게 반영되고 있는지 살펴보는 것은 상당히 중요한 의의가 있다. 따라서 본고에서는 지금까지 논의되고 있는 유전자원과 전통지식에 대한 통상협정에서의 동향을 살펴보고, 향후 FTA에서의 논의방향을 제시하고자 한다. 먼저 본고 제II장에서는 TRIPS에서의 유전자원과 전통지식에 대한 선진국과 개도국의 논의동향을 살펴보고, 일부 국가의 입장이 국내 특허법 제정에 어떻게 반영되는지를 보여주고자 한다. 궁극적으로는 이들 국가들이 체결하는 FTA에 어떻게 반영되는지 그 연관성을 보여주고자 함이다. 다음으로 제III장에서는 한국과 중국이 체결한 FTA 가운데 유전자원 및 전통지식 관련 합의사항을 살펴보고, 그 경향과 특징을 찾아내고자 한다. 마지막으로 제IV장에서는 FTA에서의 유전자원과 전통지식에 대한 논의동향을 평가하고 추후 FTA에서의 논의방향을 제시하고자 한다.
Abstract
From the early 2000s, new phenomenon has appeared that genetic resources and traditional knowledges are included in Free Trade Agreements(FTA). Recent FTAs concluded since Nagoya Protocol came into force in October 2010, specifically states important requirements of Nagoya Protocol. Especially, it is characteristic that China leading developing countries in TRIPS is reflecting her stance in FTAs China has concluded. While genetic resources and traditional knowledge is an important trade agenda, Korea concluded FTA with China which has rich biodiversity and owns common genetic resources and traditional knowledge with Korea. As a result, it is meaningful to analyze Korea and China’s agreements regarding genetic resources and traditional knowledge because China’s government is strengthening protection of genetic resources and traditional knowledge before and after Nagoya Protocol. Therefore, this paper examines tendency of the way of agreeing genetic resources and traditional knowledge in trade agreements including TRIPS and FTA, and presents direction in future FTAs. First of all, chapter II of the paper examines tendency of developed countries and developing countries regarding genetic resources and traditional knowledge in TRIPS, and shows some countries how to reflect their situations to their domestic legislation. Ultimately it is to show the linkage that their stance regarding genetic resources and traditional knowledge how to reflect their FTAs. In chapter III, the paper is going to find tendency and characteristics in the FTAs which Korea and China concluded respectively including Korea-China FTA. Finally in chapter IV, the paper tries to expects future directions to discuss in FTAs regarding examines tendency of genetic resources and traditional knowledge.
