디자인권 침해판단에서의 기능적인 특징 부분의 취급 ―미국에서의 논의를 중심으로―

최근 미국과 유럽연합 공동체디자인 실무에서는 디자인권의 침해판단에서 기능적인 특징 부분의 중요도를 낮게 취급하려는 경향을 보이고 있다. 그러나 이러한 방식은 디자인의 외관을 개별적으로 분석하는 기법을 사용하기 때문에, 전체관찰의 원칙과 어울리기 매우 어렵다. 디자인의 개별 특징들마다 기능적인 영향을 받았는지 여부를 세밀하게 조사하여 그 중요도를 파악하는 것은, 디자인권 보호의 본질을 훼손할 가능성이 크다. 물품 외관의 특징이 채택된 이유(기능적인 이유)를 세밀하게 분석하는 것은 전체관찰의 원칙에 반하는 결과로 나타나기 쉽다. 디자인의 구성요소적 분석으로 발생하는 문제점을 줄이기 위해서는 디자인권의 침해판단에서 기능성 고려를 최소화할 필요가 있다. 즉 디자인의 개별 특징이 순수하게 기능에 의해서만 결정된 경우(대체디자인이 존재하지 않는 경우)에 한하여 그 기능적 특징을 침해판단에서 고려할 필요가 있다. 그러나 이 경우에도, 그 부분을 비교의 과정에서 완전히 제거해서는 안 된다. 다만 다른 부분과의 관계에서 그 중요도가 낮게 취급될 뿐이다. 이에 비하여 디자인의 개별 특징이 단지 기능과 관련되어 있을 뿐인 경우(대체디자인이 존재하는 경우)에는, 중요도에 차이를 두어서는 안 된다. 이렇게 함으로써 물품 외관의 전체적 시각적 효과를 보호한다고 하는 디자인 보호의 목적을 달성할 수 있을 것이다.
Abstract
Functional portion and ornamental portion should not be strictly distinguished in the judgment of infringement of design right. In recent years, in the US and EU community design practices, functional features are treated as having low weight in the assessment of the design’s scope of protection. However, since this method uses a technique of analyzing the appearance of the design separately, it is against the principle that design right protects the overall visual appearance. In order to reduce the problems caused by the component analysis of the design, it is necessary to minimize the consideration of functionality in the assessment of the scope of protection of a Registered Design. If the individual feature of the design is decided solely by the function, it is necessary to consider its functional purpose in the infringement judgment. In this case, however, the part should not be completely excluded from the process of comparison. On the other hand, if the individual features of the design are only related to the function, then the weight should not be different. By doing so, it is possible to achieve the object of design protection to protect the overall visual effect of the appearance of the product.
