본 연구는 우리나라의 대체거래소 개념인 다자간매매체결회사제도의 현황과 미국의 대체거래소(Alternative Trading System: ATS) 관련 제도 및 사례를 조사하고 글로벌 금융위기 이후 파생상품 대체거래소의 설립 및 대체거래소 규제의 변화에 대하여 살펴보았다. 미국의 Dodd-Frank법 제정에 의해 금융상품의 거래시설 규정을 비롯하여 금융시장 전반에 대한 규제의 강화와 규제의 정비작업이 어떻게 변화했는지를 검토하여 향후 우리나라 다자간매매체결회사제도와 관련한 제반제도의 개선방안을 제시해 보았다. 2013년 자본시장법의 개정으로 도입된 다자간매매체결회사제도가 우리나라 증권시장에 제대로 설립되어 거래소시장의 경쟁을 촉진하고 이를 통하여 거래수수료 인하 및 제반 증권거래 서비스가 고도화 투명화 되고 시장비용을 절감하여 증권시장의 효율성을 제고시키기를 희망한다.
Abstract
This study investigated the current status of multilateral trading system, which is the concept of alternative trading system in Korea, and the system and cases related to the Alternative Trading System(ATS) in the United States, and examined the establishment of derivatives ATS and changes in the regulation of ATS after the global financial crisis. The study examined how the regulation of financial products, including the regulation of transaction facilities, and the improvement of regulation on the overall financial market have changed under the Dodd-Frank Act of the United States, and suggested improvements of various systems related to the multilateral trading system in Korea in the future. The multilateral trading system introduced by the revision of the Capital Markets Act in 2013 is established properly in the Korean stock market, which promotes competition in the exchange market, and through this, it is hoped that the transaction commission reduction and all kinds of securities transaction services will be upgraded and transparent and market cost swill be reduced to improve the efficiency of the securities market.
