민간조사관 자격시험 및 교육훈련 제도모형에 대한 연구

본 연구는 향후 사실조사 서비스시장에서 민간조사관의 전문성과 윤리성이 담보되어야 할 필요성을제기하면서, 민간조사관 제도 도입 논의의 기초로서 명칭의 문제와 민간조사관 제도 관련 법안 내용, 외국의 민간조사 자격 및 교육훈련 제도, 국내타 직역의 자격시험 제도 등을 검토하고 제도 안착의 핵심인 자격시험 및 교육훈련 제도에 대한 효과적 모형을 구상해보았다. 민간조사시장에서의 불법행위를 방지하고 민간조사활동을 제도화하기 위해 민간조사관의 전문성과윤리성을 강화해나갈 필요성은 분명하다. 그러나한편으로 실질적인 제도의 안착을 위해서는 조사업자체를 지나치게 규제해서는 안 될 것이다. 즉 민간조사업의 탈법위험은 통제하되 산업 자체의 성장과 효율성이 확보될 수 있도록 해야 한다. 따라서민간 요구에 의한 조사업 시장의 자연스러운 확대가 유도되어야 하며, 그런 점에서 민간조사관의 자격은 민간조사에 관심이 있는 일반국민에게 개방되어져야 할 것이다. 또 하나 중요한 것은 민간조사업에 대한 적절한유인(incentive) 제도가 고안(design), 운용되어야 한다는 점이다. 민간조사업은 향후 전문영역별로 발전할 것으로 전망되며, 전문성과 윤리성이 담보되기만 한다면 보다 많은 경제주체들이 민간조사분야에서 활동할 수 있도록 하는 유인정책을 쓸 필요가 있다. 마지막으로 민간조사제도가 그 시행과정에서 발생할 혼란을 최소화하고 실효적 평가제도로서 안착하기 위해서는 도입의 폭과 속도(speed) 면에서점진주의(gradualism) 방식을 취하는 것이 바람직하다. 민간조사제도를 보다 넓은 분야에서 빠른속도로 추진되어야 한다는 요구도 있을 수 있겠으나, 타 직역 영업범위 조정과 관련법제 정비, 시장인프라 구축 등 제도적 제약으로 급진적 제도변화가 쉽지만은 않은 조건에 있기 때문에 그 제도화는점진적인 수순(sequence)을 밟아 추진되는 것이현실적인 경로일 것이다.
Abstract
With the rapid growth of the fact-finding service market, the private investigation issues have recently emerged which include the professionalism and ethics of private investigator, especially the certification exam, education and training for them. In the perspective of new institutionalism, with an idea of the minimization of illegal risk and transaction cost in the private investigation market, this study is to grope for the effective institutional model of the certification exam, education and training. It is clearly obvious that the professionalism and ethics of private investigator should be strengthened with a view to deter illegal behavior,moreover, for the institutionalization of private investigation activities. However, on the other hand, private investigation industry should not be inordinately regulated for the substantial establishment of private investigator institution, that is, for the securing of efficiency under the control of illegal risk. In this context, the private investigation industry should be open to the general public interested in private investigation, with the incentive system building and gradual institutionalization program of private investigation.
