현실불만형 묻지마 범죄에 대한 고찰

본 연구는 표출적 범죄의 유형 중 하나인 ‘현실불만형 묻지마 범죄’에 대한 형사적인 접근이 아닌 사회적인 접근의 필요성을 알아보았다. 이를 위해 기존의 묻지마 범죄에 대한 논의들을 살펴보고 선행연구들의 분류체계에서 구분된 묻지마 범죄의 하위 유형중 하나인 현실불만형 묻지마 범죄를 특정하였다. 더불어 이를 해석하기 위한 틀로 T.H. Marshall의 시민권 이론을 활용하여 범죄자들이 가진 사회적 배경이 이들의 실질적인 시민권에 영향을 미칠 수 있는 가능성을 확인하였다. 이에 이어서 범죄자들에서 특정되는 실질적 시민권의 차이는 개인이 속한 사회적 정체성에 부정적인 영향을 미칠 수 있다는 점을 확인하고, 기존의 범죄학적 연구를 통해서 사회적 정체성과 범죄 사이를 강한 연관성을 추가로 특정함으로써 시민권적 위세의 차이와 범죄사이의 연결고리를 구성해보았다. 이상과 같은 과정을 통해 본 연구에서는 ‘현실불만형 묻지마 범죄’라는 범죄현상의 종류에 대한 넓은 의미에서의 사회적인 접근의 중요성과 ‘사회적 정체성’과 같은 새로운 변수에 대한 연구의 필요성을 확인하였다.
Abstract
This study addressed the needs of sociological approach to one of the expressive crime type so called “social complaint based Non- specific Motive Crime” beyond a criminal justice approach. To achieve a research goal, this study reviewed articles on the ‘Non-specific motive crime’ and identified Social compliant based non-specific motive crime as a subtype of it. Adding to that, by adopting Citizenship theory of T.H. Marshall, this study certified the possible effect of the sociological backgrounds of criminals to the substantial citizenship. In terms of linking between the citizenship theory and criminality, this study identified strong connection with criminality and ‘social identity’ that can be diversified by one’s own substantial citizenship. As a result, this study claimed the needs of sociological approach to the “social complaint based Non-specific Motive Crime” and further research on ‘Social Identity’ as a crucial variable in the criteria of criminal justice
