다중흐름모형을 통한 고위공직자범죄수사처 설치과정 연구

고위공직자범죄수사처는 고위공직자 또는 그 가족이 범한 직권남용, 수뢰, 허위공문서 작성 및 정치자금 부정수수 등의 특정범죄를 척결하고, 공직사회의 특혜와 비리를 근절하여 국가의 투명성과 공직사회의 신뢰성을 높임으로써, 국민 모두에게 균등한 기회가 보장되는 정의롭고 공정한 나라를 만들기 위한 기관이다. 고위공직자범죄수사처 설치를 위한 「고위공직자범죄수사처 설치 및 운영에 관한 법률」이 제정되는 과정을 시기별로 구분한 뒤 다중흐름모형을 통해 이론의 적합성과 다른 점 등 정책 결정 과정에서의 특징과 함께 각 흐름의 결합과 정책혁신가의 역할이 정책 결정에 중요하다는 정책적 함의를 도출하였다. 구체적으로 살펴보면 첫째, 각 흐름의 원활한 조성과 대두 여부가 정책 결정에 영향을 미친다는 점과 흐름은 대두하였지만 결합하지 못하는 경우 정책의 창이 열리지 않으며, 또 각 흐름이 동시에 모두 결합할 때 바람직한 결과가 산출된다는 주장의 적합성을 확인하였다. 둘째, 국가원수의 정책혁신가로서 역할을 하는 부분에 대한 중요성과 함께 국가원수 역시 각 흐름의 뒷받침을 받아 추동력을 확보해야 정책 결정에 이바지할 수 있다는 다른 점도 발견하였다. 셋째, 정책결정자들은 시간 제약에 따라 의사결정을 한다는 주장이 적의함을 확인할 수 있었다. 끝으로 다중흐름모형은 한국과 같이 정책체제의 분화 정도가 비교적 낮고, 정책이 갑자기 결정되거나 수시로 변동되는 경우에 유용한 이론이라는 연구결과도 사례연구를 통해 그 적합성을 고찰할 수 있었다.
Abstract
The High-ranking Public Officials Crime Investigation Office eliminates certain crimes, such as abuse of authority committed by high-ranking public officials or their family members, filing of fraudulent official documents, and illegal receipt of political funds, and eradicating the privileges and corruption of public officials to ensure the transparency of the state and the reliability of public officials. As an institution to create a just and fair country that guarantees equal opportunities for all citizens by raising the level, the process of enacting the 「Act on the Establishment and Operation of High-Level Public Officials Crime Investigation Center」 for establishment of this institution is divided by period. Through the multiple streams framework, we derive policy implications that the combination of each flow and the role of policy innovators are important in policy making, along with the characteristics of the policy decision process, such as the suitability and differences of the theory. Specifically, first, the fact that the smooth composition of each flow and whether or not it rises affects the policy decision, and if the flow rises, but cannot be combined, the policy window does not open, and when each flow is combined, the desired result is We confirmed the suitability of the claim to be produced. Second, along with the importance of the role of the head of state as a policy entrepreneur, it was also found that the head of state can contribute to policy decisions only by securing the driving force supported by each flow. Third, it was confirmed that the assertion that policy entrepreneur make decisions based on time constraints is appropriate. Finally, the research result that the multiple streams framework is a theory that is useful when the degree of differentiation of the policy system is relatively low as in Korea, and the policy is suddenly decided or changed from time to time, it was also possible to examine its suitability through a case study.
