UN 사이버범죄협약의 초안과 국내법의 비교에 관한 연구

나날이 커지는 사이버범죄의 위협에 대응하기 위해 UN에서는 사이버범죄협약 제정을 위한 논의가 진행되고 있다. 이 협약이 최종 성안되면, 회원국인 우리나라 역시 협약에 따라 국내 법제도와의 비교·검토를 거쳐 이행입법을 해야한다. 그러나 2019. 12월 러시아의 주도로 시작된 UN 사이버범죄협약에 대한 논의가 코로나19로 인해 중단된 기간이 길었던 탓에 지금까지도 관련 내용이 널리 알려지지 않았고, 이에 대한 연구도 거의 이뤄지지 않았다. 하지만 이제는 6차례의 논의를 거쳐 UN 사이버범죄협약의 최종 초안(Zero Draft)이 제출된 단계이고, 이 초안이 큰 수정 없이 UN 총회에 상정될 것으로 예측되는만큼, UN 사이버범죄협약의 논의과정과 최종 초안에 대한 세심한 연구가 필요해졌다. 본 연구는 UN 사이버범죄협약의 논의과정과 최종 초안(Zero Draft)이 도출되는 과정과 배경을 설명하고, 유사한 내용을 규정하고 있는 부다페스트 협약과 최종 초안(Zero Draft)의 차이점을 비교한 다음, 최종 초안(Zero Draft)과 국내법을 비교함으로써 향후 우리나라가 진행해야할 입법방향에 대해 논의하고자 한다. 본 연구를 통해 향후 이행입법이 이루어지면, UN 사이버범죄협약과 국내법과의 충돌이 최소화됨으로써 사이버범죄에 대한 우리나라의 대응력이 강화될 것으로 예상된다. 또한 UN 사이버범죄협약에 부다페스트조약과도 유사한 조문들이 다수 있다는 점에서, 본 연구가 부다페스트 협약 가입 및 후속 이행입법 준비에도 의미가 있을 것으로 보인다.
Abstract
In UN, discussion on a cybercrime treaty to fight against the increasing threat of cybercrime is ongoing. With the adoption of the agenda, the Republic of Korea, one of the State Parties, should analyze the comparison and conflicts between domestic legal system and the treaty to follow the implementing acts. However, with the COVID 19 pandemic, which broke out right after the discussion on the treaty initiated with the lead of Russia, the discussion was entirely suspended and became comparatively unnoticeable to the public. But at the moment, the zero draft of the treaty is about to be finalized via 6 times of discussion, and as the draft is anticipated to be proposed to UN General Assembly with little revision, it is necessary to closely speculate on the progresses of the discussion on the treaty and the zero draft. This study explains the progresses of the discussion and the procedures and background of how the zero draft is derived. Also, this study contrasts the zero draft with the Budafest Convention, which defines and regulates the similar contents. Finally this study contrasts the zero draft with the domestic legal system to discuss on the legislative direction that the Republic of Korea should later progress. The legislation inspired from his study will decrease the conflicts between UN cybercrime treaty and the domestic legal system, which eventually will strengthen the security and response of the Republic of Korea. Moreover, since UN cybercrime treaty and Budafest convention share common articles, this study will be meaningful in preparation to join Budafest Convention and follow with implementing acts.
