(The the United Nations Convention against Cybercrime, 이하 유엔 협약)’을채택하였다.

Abstract

To deal with the growing threat of cybercrime, which is increasingly organized and transnational in nature, the Council of Europe adopted the Convention on Cybercrime, commonly known as the Budapest Convention, while the United Nations has recently adopted the United Nations Convention against Cybercrime (hereinafter referred to as the “UN Convention"). South Korea is currently preparing to accede to both conventions simultaneously, necessitating revisions to domestic legislation to adequately reflect the provisions of each. However, legislative reviews for implementation tend to focus primarily on procedural measures or provisions related to international cooperation, where corresponding domestic laws are absent. In contrast, substantive criminalization provisions, which already have domestic counterparts, often receive insufficient attention and are not subjected to in-depth analysis. An examination of the criminalization provisions in the recently adopted UN Convention reveals areas where supplementary legislation in South Korea may be necessary. For instance, Article 8 of the UN Convention addresses the interception of electromagnetic emissions, Article 11 covers the sale, distribution, or otherwise making available of access data, and Article 14 pertains to acts such as Soliciting, procuring or accessing related to child exploitation materials even prior to possession. These areas require particular legislative focus to ensure full compliance. Cybercrime has long been characterized by offenders possessing technological capabilities that exceed those of investigative authorities, with crimes increasingly executed through modular and specialized operations. Consequently, domestic legislation must evolve to comprehenvely cover the diverse and complex nature of such offenses. It is hoped that South Korea's preparations for accession to these conventions will serve as an opportunity to enhance and advance its cybercrime-related legal framework, creating a robust foundation for addressing both current and future challenges in this domain.
