온라인상 아동·청소년 성착취 피해의 특성과 정책 개선방안: 사이버성폭력수사 경찰관의 경험을 중심으로

본 연구는 온라인상 아동·청소년 성착취 피해의 특성과 미성년자 피해자 수사 과정에서 발생하는 어려움에 대해 파악하여 아동·청소년 성착취 범죄 대응의 방향과 향후 정책 개선방안을 모색하기 위한 목적에서 수행되었다. 이를 위해 전국 지역청 사이버성폭력수사팀 소속 경찰 11명에 대한 심층면접을 진행하고 그 결과를 분석하였다. 분석 결과 대다수의 아동·청소년 피해자는 자신의 피해 사실이 부모에게 알려지는 것을 크게 두려워하고 있었고, 따라서 피해 사실을 드러내거나 도움을 요청하지 않고 신고를 포기하고 있었다. 다수의 신고는 우연히 자녀의 피해 사실을 알게 된 부모에 의해 이루어졌고, 경찰 인지수사 과정에서 발견되기도 하였다. 신고 이후에도 적지 않은 피해자들은 자신의 경험을 성착취 피해로 인지하지 못하거나, 부모가 동석한 상황에서 구체적인 피해 양상을 진술하는 것을 꺼려 수사에 많은 어려움이 발생하고 있었다. 급변하는 기술 발전으로 인해 기술매개 성범죄 수사의 전문성과 국제공조의 필요성이 점차 높아지고 있었고, 2차 피해 예방 및 방지를 위해 피해자 보호 및 회복에 초점을 맞춘 수사 목적 전환의 필요성이 제기되었다. 또한 아동·청소년 성착취 사건을 수사하는 대부분의 경찰들이 외상 후 스트레스 장애(PTSD)나 대리외상 등의 심각한 정신적 어려움을 겪는 것으로 나타나 수사관의 업무상 스트레스 관리 및 정신건강 지원 방안이 적극적으로 모색되어야 할 필요가 있음을 확인하였다. 이러한 연구 결과를 바탕으로 결론에서는 피해자 보호와 회복에 중심을 두는 수사 목적의 방향 전환과 시스템 개선, 현행 보호자 통지 및 신뢰관계인 동석 제도의 효과성에 대한 점검과 개선, 수사 전문성 강화를 위한 실효성 있는 교육 개발 및 수행, 수사관 소진 방지와 정신건강 회복을 위한 구체적인 지원 방안 마련 등을 향후 정책 대응의 방향과 과제로 제시하였다.
Abstract
This study aimed to exmaine directions for improving investigative practices to better understand, prevent, and respond to online child and adolescent exploitation crimes by exploring the experiences and perceptions of investigators in charge of online child and adolescent sexual exploitation crimes. In-depth interviews were conducted with a total of 11 police officers from cyber sexual violence investigation teams across the country. Findings of this study suggest that a significant number of online child and adolescent sexual exploitation victims were extremely reluctant to seek help or report the incidents. In many cases, reports were made by parents who accidentally discovered their child’s victimization. Even after reporting, a considerable number of victims had difficulty recognizing their victimization, which affects hinder the investigative process. Presence of persons with reliable relation and notification to guardians, which are originally designed to protect minor victims, were found to have an impact on the passivity of victim statements. In the context of technology-facilitated sexual violence, expertise in investigations and international collaboration were highlighted as crucial. There were also demands from the victim's perspective for secondary harm prevention and comprehensive victim support. Based on these findings, the conclusion discusses the need for a focus on victim protection, support, and recovery in investigative purposes, as well as the development and implementation of effective training for system improvement, strengthening investigative expertise, and establishing various support systems for the protection and recovery of investigators' mental health while addressing conflicts with the rights of victims and the improvement of notification systems and presence of persons with reliable relation.
