방첩관련 조직체계와 법체계의 개선에 관한 연구- 미국, 영국 및 독일과의 비교를 중심으로 -

초록

오늘날 지식·정보화, 국가경쟁력 중시, 적국과 우방국의 구별 상대성 등으로 인하여 국가안보의 대상영역과 위협주체가 변화되고 있다. 많은 나라들은 방첩환경의 변화에 대응하여 국가안보기구 안에 새로운 방첩제도들을 창설하고있다. 본 연구의 목적은 미국, 영국 그리고 독일의 방첩조직체계와 법체계의 특성을 비교분석하고, 이를 바탕으로 우리나라의 문제점들을 검토하고 개선방안을 제시하는 것이다. 주된 연구방법은 문헌조사이며, 보완적 방법으로 국가안보 전문가들에 대한 면접을 하였다. 한국의 대북한 간첩수사에 초점을 둔 소극적·수동적 간첩개념에 입각하고 있는 점이 가장 큰 문제점이다. 정보조직간의 정보 공유를 위한 정보 공동체 및 강력한 조정기능을 담당하는 총괄조직을 갖추지 못하고 있는 것도 또 다른 문제이다. 또한 변화하는 방첩환경에 부응하여 법체계를 갖추지 못하고 있다. 이러한 분석을 바탕으로, 방첩조직체계의 개선방안으로 포괄적 방첩개념 정의 및 방첩조직의 직무범위 확대; 정부기관 및 우방 방첩활동기관들과 지식과 자원을 공유하기 위한 정보공동체 형성; 미국의 국가정보국과 같은 총괄조직 창설 등을 제안한다. 방첩관련 법령의 개선방안으로, 방첩대상으로서 ‘적국’, ‘반국가단체’ 규정을 비국가행위자를 포함한‘외국’으로 대체; 미국의『애국법』이나 영국의『대테러, 범죄 및 안전법』과 같은 『방첩법』 제정 등을 제안한다.

Abstract

In recent years, target areas and main agents of National Security are changing because of theintellectualization and informatization, valuing national competitiveness, the relative relationshipbetween enemy country and ally. In response to these changes, many countries are creating newcounterintelligence institutions within their national security establishments. The first goal of thisstudy is a comparative analysis of Korea’s intelligence machinery and legal system against counterintelligenceof USA, UK, and Germany. Secondly, this study identifies problems within Korea’s existingsituation and makes suggestions for improvement. The main method of this study is a literaturesurvey complemented by interviews with specialists on national security. The fundamental problem of the intelligence organizations and legal system of the Korean governmentis that it is based on a negative·passive counter intelligent concept focusing mainly oncounterespionage in North Korea. Another problem is the lack of an intelligence community and acontrol organization with strong coordination function. Also, there is a weak legal system againstcounterintelligence in response to the changing intelligence environment. As improvement alternatives for the intelligence organization system, this study suggests to definethe comprehensive counterintelligence concept; to broaden activities of national informationagency; to institutionalize the intelligence community which sharing of expertise and resources ofgovernment agencies, and global partners to combat foreign intelligence activities; to organize coordinationagencies like ODNI of USA. As improvement alternatives for legal systems against counterintelligence,this study suggests to substitute enemy country or anti-government organization withforeign entity while including non-state actors; and to create counterintelligence laws like the USAPatriot Act, or the UK Anti-Terrorism, Crime, and Security Act.
