해외 방첩법제 비교를 통한 정책적 시사점 연구

세계적으로 정보활동의 범위가 대폭 확대되고 국제테러단체 등 국가 이외의 안보위협 집단이 출현함에 따라 방첩활동의 영역이 급속히 확장되고있다. 반면에 우리나라의 방첩활동은 분단국가라는 특수성으로 인해 북한을 상대로 한 방첩활동인 대공활동에 국가 방첩역량의 대부분을 투입해온관계로 여타 외국에 대한 방첩활동을 상대적으로 소홀히 해 온 것이 사실이다. 본 연구는 해외 방첩관련 입법사례와 국내실태에 대한 비교분석을 통 하여 우리의 방첩역량 강화를 위한 법⋅제도적 문제점과 과제를 살펴보았 다. 즉 세계 각국 정보기관들이 선제적이며 능동적인 방첩시스템을 지향하고 있는 시점에서 해외 방첩관련 입법사례와 우리 방첩실태를 비교분석한 결과 우리 방첩업무기반을 확충하고 방첩역량의 제고를 위해서 법⋅제도적 정비방안으로, 방첩용어의 대체방안 연구와 범위규정, 간첩죄의 구성 요건에 대한 정비, 국가기밀에 대한 명확한 개념 및 범위 명시, 간첩행위 및 양태의 구체적 명시, 안보현실을 반영하지 못하는 동맹국 비밀보호조항의 폐지, 경제방첩 및 기타 사이버 관련 법제정비 등을 제안하였다. 아울러 선진방첩체계 구축을 위한 제도적 개선방안으로는 방첩활동의 강화 및 정보통합성의 지향, 국가방첩의 최고책임자로서 국가방첩관 직제설치, 경제방첩및 사이버안보 관련 민관 협력거버넌스 체계의 구축, 국가정보 조직체계개편에 따른 방첩역량약화의 최소화 등을 제안하였다. 안보위협요소가 확대되고 방첩활동영역 및 대상이 다양해지고 있는 변화된 정보환경에서 원활한 정보활동에 대한 합리적 규제나 감시를 마련하지 많아 제도적 미비점이 드러나게 되면 이것은 결국 심각한 방첩활동의 약화로 나타날 것이며 그피해는 온 국민이 다 겪어야 될 것이다. 이런 관점에서 먼저 국가방첩의 개념이나 이론적 방향을 시대적 상황의 변화를 고려하는 방향으로 개선해 나가고 이러한 연구를 토대로 방첩역량의 강화를 위한 방향을 설정하여 방첩업무 기반확충에 필요한 법제적 정비방안과 개선조치들을 마련해 나갈 필요가 있다.
Abstract
As the realm of intelligence activities extends globally, the scope of counterintelligence is also rapidly expanding. Owing to the harsh reality of a divided country, South Korea had once put more efforts on anticommunist activities than working on counterintelligence against foreign intelligence services. Under the Cold War structure, it is natural for Korean counterespionage services to narrow down its targets only to threats coming from hostile North Korea. South Korea is now in a situation to positively respond to new CI challenges dictated by such rapid intelligence conditions. The main impetus for this research is to explore into the implications of the study on foreign CI services for improvement of Korea’s CI capacity. As a result of analyzing a few cases of foreign countries’ efforts to improve their CI capacity, this study suggests some legal and institutional alternatives as follows. First, efforts should be doubled to strengthen national CI capacity by revising outdated laws to the extent of meeting the needs of a changing society. Secondly, in order to effectively respond to newly–emerging CI threats, much efforts should be given on the specification of CI concept and scope. Thirdly, also needed is the enhancement of the CI efficiency through the institutional restructuring of the intelligence services. Of course, these tasks can not be realized over such a short period, but provided such demanding security challenges Korea is facing, the first priority should be given on upgrading the level of CI activities by learning from foreign countries’ experience and their advanced CI systems.
