이 연구의 목적은 광역 및 기초 자치단체의 노동자 건강증진 조례에 관한 비교 연구를 통해 조례의 개정 방안을 도출하는 것이다. 이러한 연구목적을 달성하고자, 선도적으로 노동자 건강증진 자주조례 를 제정·시행 중인 5개 지방자치단체의 ‘노동자 건강증진 조례’를 내용분석 방법으로 비교 분석하였다. 분석결과, 전반적으로 경기도 조례가 사회복지조례의 내용적 체계에 가장 부합하였다. 조례 개정 방안 으로서, 「대한민국헌법」에서 규정하고 있는 ‘노동권’과 ‘건강권’에 부합하는 ‘노동자의 권리’ 조항 신설, 기본계획 주기 명시, 연도별 시행계획 신설, 실태조사 실시의 강행규정 명시, 취약노동자(특수형태근로 종사자 및 이주노동자) 규정 정비 및 플랫폼노동자 등 범위 확대, 타 자치단체의 급여 항목 벤치마킹을 통한 급여종류의 포괄성 확대, 기본계획 수립·시행 조항에 재정 소요 추계 및 재정 조달 사항 신설, 노 동자 건강관리지원단 설치·운영 신설 및 위해환경 노출경험 노동자 등 당사자의 위원회 참여 보장을 제 안하였다. 향후 노동자 건강증진 조례 제정 과정에서 표준적으로 제시되어야 할 조항들을 제시하였다. 본 연구결과가 지방자치단체의 노동자의 건강증진 조례 제정에 기여할 수 있을 것이다.
Abstract
The purpose of this study is to derive a plan for revising the ordinance through a comparative study on the worker health promotion ordinances of metropolitan and basic local governments. In order to achieve this research purpose, the ‘Worker Health Promotion Ordinances’ of five leading local governments that are enacting and implementing worker health promotion ordinances were compared and analyzed using content analysis. As a result of the analysis, overall, the Gyeonggi-do ordinance was most consistent with the content system of the social welfare ordinance. As a plan to amend the ordinance, establish a new ‘workers’ rights’ clause that is in line with the ‘right to work’ and ‘right to health’ stipulated in the Constitution of the Republic of Korea, specify the basic plan cycle, establish an annual implementation plan, specify mandatory provisions for conducting a fact-finding survey, Reorganizing regulations for vulnerable workers (special workers and migrant workers) and expanding the scope of platform workers, etc., expanding the comprehensiveness of salary types by benchmarking the salary items of other local governments, estimating financial requirements and raising funds for basic plan establishment and implementation provisions. It was proposed to establish new matters, establish and operate a worker health management support group, and ensure participation in the committee by workers with exposure to hazardous environments. Provisions that should be presented as standards were presented. The results of this study may contribute to the enactment of worker health promotion ordinances in local governments.
