실종아동의 실태와 효과적인 대응방안에 관한 연구

‘한 아이를 키우기 위해서는 마을 전체가 필요하다’는 말이 있다. 아동은 절대적인 사회적 약자이고, 동시에 우리 사회의 미래이기 때문에 아동을 대상으로 하는 범죄는 아동과 그 부모에게만 고통을 주는 것이 아니라 사회 전체에 큰 고통을 주는 범죄이다. 특히 실종아동과 관련된 범죄로 피해를 입은 아동과 부모는 우리 사회가 각별하게 관심과 애정으로 그들의 아픔을 보듬어 주는 공존의 책임을 져야 할 사안이다. 최근 경찰청의 자료에 따르면 2006년부터 2011년 3월까지 만14세 미만 아동 실종자는 총 4만7,180명으로 하루 평균 23.6명이 실종되었다. 2007년 8,602명, 2008년 9,470명, 2009년 9,240명, 2010년 1만829명, 2011년 3월 기준 1,975명으로 매년 증가추세인 것으로 나타났다. 아동에게 있어 부모와 떨어져 격리되는 경험은 극도의 불안감과 스트레스, 분노 등을 야기할 뿐만 아니라 평생토록 지워지지 않는 심리적 충격으로 남게 되며 심한 경우에는 외상후 스트레스장애(PTSD)를 유발하게 된다. 또한 부모는 자식이 실종되면 모든 일상생활을 포기하고 자식 찾는 일에만 전념하게 된다. 그러한 상황이 장기화 될수록 부모의 죄책감과 우울증 증세는 더욱더 부정적인 감정으로 발전하고, 경제적인 어려움도 겪게 되며, 대인관계도 소홀해 지는 등의 심각한 사회문제로까지 발전하게 된다. 이처럼 오랫동안 우리사회는 실종아동에 대한 문제의 심각성에도 불구하고 이러한 문제를 개인의 문제, 실종아동 가족의 책임으로 치부하는 경향이 있어 왔다. 매년 경찰에 접수되는 실종 사건은 실종아동 사건을 포함하여 5만-6만 명에 이른다고 한다. 이렇게 많은 실종사건의 발생은 우리사회에서 실종아동 범죄를 이슈화하면서 국가 차원의 적극적인 예방과 대책 마련의 중요성을 인식하게 되었으며, 특히 경찰은 최일선에서 실종아동에 대한 수사를 하고 있어, 초동수사를 통한 조기발견 등 예방과 수사에 있어 경찰의 역할이 중요하게 자리 잡고 있다. 이러한 현 실태에 입각하여 본 논문은 실종아동에 대한 현재의 실태 현황과 선진국의 실종아동에 대한 보호 및 수사체계, 실종아동 수사의 문제점 그리고 이를 해결하기 위한 경찰의 수사 대책과 정부 및 관계기관의 대응방안을 제시하고자 한다.
Abstract
There is a statement saying ‘The whole town is needed to raise one child.’ The crimes targeted to children are not only distress to the parents of the children but also the entire society due to the consideration that children are the underprivileged in society and the future of our society as well. Especially, it is society‘s mutual responsibility to pay special attention and care to the victim of kidnapping crimes. According to the recent survey data by police, 47,180 children who are less than 14 years old have been missing in the period of between year 2006 to March of 2011, average 23.6 children per one day. Furthermore, the data is increasing from 8,602 in 20007, 9,470 in 2008, 9,240 in 2009, 10,829 in 2010, and 1,975 by March of 2011Children not only experience the extreme anxiety and stress, rage and much more by separating from their parents, the crimes cause a serious mental impact and PTSD in some extreme cases. Furthermore, the parents of missing children leave everything behind to find their children. If the cases prolongs for a longer period, parents experience guiltiness and depression, which leads them to negative thinking, economic difficulty, and interpersonal relationship problem that will cause the serious society problem. Although kidnapping has been seriously dealt with our society, our society has been showing the tendency of dismissing this problem to either personal problem or issue of victim’s family. The missing cases registered to police are 50,000-60,000 cases every year, including the children cases. Thus, kidnapping in our society has been recognized as the major issue in terms of importance of national prevention and setting its measures. Especially, police as being the very front as the investigator on kidnapping cases, the role of police has been extremely essential through preliminary investigation and early detection. According to the above fact, this study intends to elaborate on overview of the missing children, protection and investigation procedure examples in developed countries, and problems in investigation procedure and following improvement in solution from police investigation, government and relating institutions.
