본 연구에서는 선진국의 경찰공무원 노동단체의 현황 및 공과 등에 대한 동향을 살펴보고, 현재 허용하고 있지 않은 우리나라에서 어떠한 교훈과 시사점을 찾아볼 수 있는지를 알아보았으며, 우리나라에서의 경찰공무원 노동단체에 대한 기존의 논의과정과 쟁점사항 등을 토대로 이와 관련한 내용을 전망해 보았다. 미국 등 대부분의 선진국은 경찰공무원 노동단체를 인정하고 있으며, 이들은 경찰의 발전을 위하여 경찰공무원의 임금이나 작업환경에서부터 경찰관련 정책이나 집행에 관한 부분까지 경찰조직을 위하여, 그리고 일선 경찰공무원을 위하여 여러 가지 활동을 해 왔으며, 많은 역할을 해 오고 있다. 그러나 노동단체가 이익집단화 될 우려가 있고, 파업을 강행하면 사회가 공황상태에 빠지게 되며, 관리층의 권한이 약화되고, 국민 조세부담이 증가할 수 있다는 우려를 들어 문제점을 제시하기도 한다. 한편 세계적인 추세를 보면 한국에서도 노동단체 또는 이전단계인 기존 공무원직장협의회 수준의 단체가 언젠가는 인정될 수 있음을 예상할 수 있다. 그러나 경찰공무원 노동단체를 어떤 수준의 단계까지 허용할 것인가의 문제, 노동기본권을 어느 정도까지 어떤 수준에서 보장하고, 제한할 것인가의 문제, 어떤 시기에 이러한 것들이 논의가 되고, 이루어질 수 있는가의 문제들은 조직 내 · 외적인 상황, 국내 · 외적인 복합 상황이 이를 허용할 때 가능할 것이다.
Abstract
In this study, the status and the merits and demerits of the labor group of police officers in advanced countries have been explored, what lessons and implications to Korea where it is not allowed currently can be sought after has been examined, and the related perspectives have been forecast based on existing discussion process and issues. Most of the advanced countries such as the United States of America recognize the labor group of police officers that, for development of the police, has exercised various activities from income or working environment of police officers to police related policies or implementations for police organization and police officers at the front and has played diverse roles. However, there are problems presented as there are concerns that the labor group may become an interest group, that enforcing a strike may cause the society to fall into a state of panic, that the authority of governing class is weakened, and that the tax burden of the nation may increase. On the other hand, looking at the worldwide trend, it may well be expected that the labor group or organization to the level of existing public officials' workplace council, which is the prior step to the labor group, will be allowed in Korea some time. However, the questions such as to what level the labor group of police officers shall be allowed, to what extent and level the basic labor rights shall be guaranteed and restricted, and at what point of time these shall be discussed and materialized should find answers when external and internal situations of the organization and complex domestic and international situations allow them.
