EU의 법치와 폴란드와 헝가리: ‘리스본조약 7조’ 적용 논란을 중심으로

이 글은 리스본조약 7조가 규정하는 EU가치 위반과 제재의 역사와 적용의 문제점을 분석한다. 구체적으로 폴란드와 헝가리의 법치위반 제재과정에서 드러난 문제점과 이의 개혁방안을 검토한다. 헝가리와 폴란드는 EU의 법치주의 위반 적용 절차에서 매우 유사한 공통점을 갖는다. 양국 모두에서 중도 우파 민족주의 정당이 총선에서 안정적인 과반을 확보했다. 이후 집권당은 사법부의 독립 훼손, 언론의 자유를 침해하는 법을 의회에서 거의 아무런 저지도 받지 않고 통과시켰다. 관련 법안의 제정과 비준부터 집행위원회는 양국에 법치 위반 우려를 전달했고 이후 대화를 가져 시정하려 했으나 그리 효과적이지 못했다. 헝가리와 폴란드의 법치위반에 대해 집행위의 제재 조치가 효력이 없으면서 이에 관한 개혁논의가 활발하게 전개되어 왔다. 조약개정은 중장기적인 목표이고 먼저 제재 조치의 효력을 제고할 수 있는 개혁이 필요하다. 현재 법치와 EU 예산 지원을 연계하는 방안이 입법과정 중에 있고 유럽의회와 독일, 프랑스의 지지를 받고 있어 실행 가능성이 높다. 폴란드와 헝가리, 체코, 슬로바키아, 루마니아 등 중동부 유럽 국가들은 EU 구조기금의 가장 큰 수혜국들이다. 예산을 제외한 법적 측면에서의 개정도 외부 전문가의 참여를 확대하는 방향으로 진행 중이다. 이 과정에서 EU의 독립 기구인 EU기본권기구(EU Fundamental Rights Agency)와 유럽평의회(Council of Europe)의 베니스위원회(The Venice Commission) 참여를 제도적으로 보장해야 한다는 제안이 지지를 받고 있다. EU의 중장기 예산 운용틀인 다년간재정프레임웍이 2020년 상반기에 합의될 것으로 보여 법치위반 제재 조항의 실효성 제고 노력도 이때쯤 판가름이 날 것으로 보인다.
Abstract
This paper aims at analyzing the breach of EU values and its implementation process with particular emphasis on Poland and Hungary. Two countries have in common that right-wing populist nationalist parties have secured a stable majority in the parliamentary elections and systematically undermined the independence of the judiciary and freedom of the press. The Commission of the European Union, as an executive arm of the Union, has tried to correct their aberrant behaviour, but in vain. Several reform attempts have been made to make the ‘rule of law’ process more effective. One of them is to link EU funding (cohesion and structural) to the observation of the rule of law. The idea is highly likely to fly, as both the European Parliament and several Member States such as Germany and France support it. Also making the outside experts, likes the Venice Commission of the European Council and EU Fundamental Rights Agency, join in the process of evaluating the rule of law is being gradually accepted. These reform efforts of the rule of law will be firstly known in 2020.
