이 글은 리스본조약 7조가 규정하는 유럽연합(EU)의 가치 위반과 제재의 개혁을 다룬다. 2020년 EU는 2021~2027년 다년간 재정전망(MFF)을 협상하면서 예산 지출과 법치주의 준수 연계를 시도했다. 폴란드와 헝가리는 법치주의를 위반할 심각한 위험이 있다고 판단되어 EU는 두 회원국에 대해 제재 예방 절차에 들어갔다. 집행위원회는 양국에서 사법부와 언론의 독립 훼손 등이 드러나 이를 시정하게 하려 했으나 성과를 거두지 못했다. 법치주의 위반 제재 결정에는 만장일치가 필요해 집행위원회는 이를 가중다수결로 바꾸고 예산 지출과 연계하려 했다. 양국이 EU예산의 순혜택국이기에 예산지출과 법치주의 준수 연계는 실행되면 큰 효과를 거둘 수 있을 것으로 보였다. 양자 연계는 이루어졌고, 제재 결정도 가중다수결로 변경이 되었으나 시행이 최소 2년 정도 연기되었다. 그리고 유럽이사회의 이런 결정에 대해 EU법을 위반했다는 비판이 나왔고 개혁이 실패했다는 평가이다. 이 논문은 EU가 법치주의 준수를 강력하게 시행할 효과적인 협상 카드를 보유했음에도 이런 어중간한 결과를 얻었는지를 분석한다. 구체적으로 EU 지도부인 순회의장국, 집행위원회, 유럽이사회 상임의장, 그리고 당사국인 폴란드와 헝가리의 국내정치적 측면에 중점을 두어 해부한다.
Abstract
This paper aims at analyzing the reform efforts of applying the breach of EU values stipulated at article 7 of the Lisbon Treaty with particular emphasis on Poland and Hungary. Two countries have right-wing populist nationalist parties since the 2010s and they have systematically undermined the independence of the judiciary and freedom of the press. The Commission of the European Union (The Commission), as the guardian of the EU treaties, has tried to correct their aberrant behaviour, but in vain. On the occasion of agreeing to the seven-year Multiannual Financial Framework(MFF) 2021-2027, the Commission along with the Presidency of the rotating Council, Germany, and the President of the European Council failed to link EU budget payment to the respect for the rule of law. As Poland and Hungary are main net beneficiaries of the EU budget, this linkage seemed to be effective way of forcing the two countries to abide by European values. The European Council in December 2020 agreed to tying budget payment to the upholding of European values, but decided to implement it by qualified majority voting after the Hungarian parliamentary election due in spring 2022. Thus, European Council was criticized to act beyond its legal authority.
