Abstract

This article introduces the Law and Literature movement in an attempt toreinterpret the Confucian legal tradition from the perspective. It isremarkable that a few American students of Chinese or East Asian legalhistory have attempted such approaches influenced by the Law andLiterature movement in their academic field. Thus, this article explores thelaw and literature perspective as a new possibility to overcome the gapbetween traditional law and modern law. The Law and Literature movement has questioned about and criticizedmodern Western law and its absolute formalism and universalism idealizedby Max Weber. As a matter of fact, there is no absolute, universal, andabstract law. The inevitable gap between law and social reality can beovercome by only the judge's "interpretation." The hermeneutic approachesprevailing the Law and Literature movement intend to reflect the reality oflegal practice and resolve the gap between law and reality. The judge's efforts to bridge the gap between law and social reality, however, seem to have been prevalent in the Confucian legal tradition aswell. Judging from the fact that Confucian judges considered the gapfundamental and strove to resolve it, it is a simple misconception thinkingthat the ruling classes never took law into serious consideration in traditionalEast Asian society. The fact that there existed a wide variety of genres ofChinese legal literature encompassing different scholarships of jurisprudence, philosophy, and history in traditional China would remind us of thecontemporary "Law and Literature" movement that calls for "returning to the humanistic tradition."Nothing was more essential than humanistic deliberation in the Confucianlegal tradition. In particular, a great emphasis on the interaction betweensentiment, principle, and law in the Confucian legal tradition should beconsidered not just as a kind of apology for concealing the judge's whim orignorance but as a kind of internalized practical norms. The complexinteraction between sentiment, principle, and law was concretely representedthrough the judge's words in a great number of legal texts such ashandbooks for magistrates, casebooks, and court-case fiction. The law andliterature perspective seems useful in drawing our attention to rhetoricalstrategies used in a number of traditional legal texts.
