Abstract

When Korea enacted its first legislation explicitly prohibiting discrimination based on sexual orientation in 2001 (the National Human Rights Commission Act) and its first ordinance prohibiting discrimination based on gender identity in 2012 (the Seoul Student Human Rights Ordinance), LGBTQ+ human rights organizations engaged in solidarity actions with other human rights and social movement groups. These actions included hunger strikes and sit-in protests. Nevertheless, sexual minorities are often foreclosed upon and treated as if they never existed. This approach dismisses the existence of sexual minorities and the discrimination they face. Even before the rise of the LGBTQ+ rights movement in the 1990s, Korean sexual minorities were subjected to arbitrary police violence and dismissed as entities that violated “public morals” and “public order.” They remained foreclosed, living through a kind of civil war and its affect. Society must not simply revert to a time before the emergence of extreme right-wing groups that despise homosexuality, as occurred before the 2024 South Korean martial law crisis. Instead, society must move toward abolishing the unique Korean hatred of sexual minorities and the resulting foreclosure.
