유럽연합은 EU회원국들이 역내 국내법으로 이행해야 하는 이른바 전자상거래에 관한 지침을 제정 발표하였다. 그 결과로, 전자상거래가 정보사회 서비스의 일부로 귀속됨을 나타내고 있다. 본 논문은 EU가 제정한 새로운 법률안을 분석하고 이를 통해 공동체 안에서 물품과 서비스의 자유로운 이동을 보장하기 위한 필수적인 요소임을 확인하고 있다. 따라서 이 논문은 전자상거래에 따른 소비자들을 보호하기 위한 지침을 제공하고 향후 기술 발전에 대한 중립적 근거를 제시하는데 일조하고자 한다.
Abstract
The European Union(EU) has enacted a series of directives including the Directive on Electronic Commerce and started harmonizing the national laws in this area. As a result of this effort, Electronic Commerce has been vitalized as a part of Information Society Services. This article would be helpful to analyze the new legislations of the EU and to show their essentials as securing free movement of goods and services by Electronic Commerce in the community. Therefore, this article would be useful to protect consumers and to maintain a technologically neutral approach to set about making further development of technology.
