전자문서관리와 전자정보거래는 상적 및 행정적 활동의 중요한 부분을 이루고 있다. 전자상거래가 크게 증가될 것으로 기대되고 있다. 전자상거래에서 전자서명과 인증 그리고 전자거래의 법적 효과의 신뢰성은 매우 중요하다. 그러므로 본논문은 1999년에 입법된 전자거래기본법과 전자서명법에서 전자서명과 전자인증을 비교법적으로 분석하고자 한다. 본 논문의 목적은 전자상거래 관련 국내법 즉, 전자거래기본법과 전자서명법에서의 법적 쟁점과 문제점을 분석하여 확인된 문제점에 대한 가능한 해결책을 도출하여 전자상거래에서의 전자서명의 사용을 증가시키는데 기여하고자 하는 것이다.
Abstract
Electronic document management and electronic information transmissions constitute an extensive part of commercial and administrative activities. It is expected that e-Commerce will be increased dramatically. In e-Commerce, trust in the electronic signature and certification and in the legal consequences of electronic transactions is very important. Therefore, this paper analyses comparatively the electronic signature and electronic certification under the fundamental law of electronic transactions and electronic signature law which enacted in 1999. The purpose of this paper is to contribute to the increase in the use of electronic signature in e-Commerce by analysing the legal issues or problems of domestic law regarding e-Commerce, that is to say, the fundamental law of electronic transactions and electronic signature law and finding the possible solutions regarding the identified obstacles.
