전자상거래 부문의 국제적 ODR협력을 위한 중국의 해결과제

연구목적: ODR을 통한 분쟁해결을 위해서는 국제적 협력이 수반되어야만 한다. 그런데 중국은 아직도 인터넷 검열이라는 제도적 장치를 고집하고 있음으로 인해 중국과의 전자상거래 관련 거래를 상당히 위축시키고 있는 실정이다. 이에 본고에서는 전자상거래의 활성화를 위한 국제적 ODR협력과 관련하여, 중국이 신속히 해결해 나가야 할 과제들에 관한 핵심 내용들을 검토해 보기로 한다. 논문구성/논리: ODR에 관한 전반적인 내용들을 검토한 후, 중국의 인터넷 관련 제재현황들을 살펴보기로 한다. 이를 근거로 전자상거래의 활성화를 위한 국제적 ODR협력체제의 구축과 관련하여 중국정부가 해결해 나가야 할 과제들을 제안하기로 한다. 결과: 전자상거래 관련 분쟁해결을 위해 ODR 부문에서 중국이 더욱 발전하게 되는 계기가 될 수 있을 것으로 판단하며, 이를 통해 오늘날과 같은 정보화시대에 ODR부문의 국제적 협력이 한층 더 발전하게 될 것으로 전망된다. 또한 현재 진행중인 UNCITRAL의 ODR부문에 대한 국제 규범 제정이 더욱 빠른 속도로 진전을 보일 수 있을 것으로 전망된다. 독창성/가치: 장차 온라인 분쟁해결을 위한 국제규범이 탄생될 것임은 명백하다고 할 수 있다. 이러한 과정에서 본고에서 제안하는 중국정부의 해결과제들이 진전을 보일 경우, ODR 부문의 국제적 규범 제정이 한층 더 빠른 속도로 진행될 수 있을 것으로 판단된다.
Abstract
Purpose: In the Chinese censorship issues, it remains highly questionable as to whether electronic commerce ODR can succeed between Chinese enterprises and other country’s business if censorship persists. Therefore, I propose the China’s solving tasks for international ODR cooperation in electronic department at this article. Composition/Logic: After the study about the advantage and distinction of ODR, I investigate the Chinese strong censorship issues and the China’s present internet control situation. And then I examine the China’s solving tasks for international ODR cooperation in electronic commerce department. Findings: Through this article, China will be progressed the ODR system in electronic commerce department. And I prospect that the international cooperation of the ODR will be promoted increasingly. Originality/Value: With the progress of the China’s solving tasks for internet censorship, I expect that the UNCITRAL’s present international regulation legislation of the ORR department will be accelerated at an increasing tempo.
