헌법은 “공공필요에 의한 재산권의 수용･사용 또는 제한 및 그에 대한 보상은 법률로서 하되 정당한 보상을 지급하여야 한다”(제23조 3항)고 규정하여 재산권의 제한과 보상에 대한 일반원칙을 규정하고 있다. 그러나 헌법은 침해된 재산가치에 대하여 어떤 방법으로 보상 을 하여야 하는가에 대하여는 규정하지 않고 개별 법률에 맡기고 있다. 따라서 개별 법률은 헌법의 보상규정을 근거로 보상의 수단과 방법에 대하여 구체적으로 규정하여 사권침해로 인해 발생한 손실 을 보상하도록 하고 있다. 이에 따라 손실보상의 일반법이라 할 수 있는 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」(이 하‘토지보상법’이라 한다)에서는 다른 법률에 특별한 규정이 있는 경 우를 제외하고는 현금으로 지급한다고 규정하여 ‘현금보상의 원칙’ 을 채용하고 (동법 제63조 1항), 예외적으로 특정한 경우에 채권으 로 보상할 수 있도록 하고 있다(동조 2항). 그러나 최근 공익사업이 대형화 되면서 현금으로 지급된 막대한 보상금이 인근지역의 대토 수요로 전환되어 전국적으로 지가가 급등하는 등의 사회적 부작용 이 발생하고 있다. 특히 손실보상금에는 당해 공익사업으로 인한 개 발이익이 포함되지 않으므로 공익사업지구에 편입되는 토지소유자 는 개발혜택의 전부를 향유하는 인근지역의 토지소유자에 비하여 상대적 불이익을 받고 있으며, 또한 인근지역의 지가상승으로 인하 여 보상전과 대등한 대체지의 취득이 불가능하여 현금보상만으로는 보상전과 동일한 정도의 생활 상태로 회복이 불가능하다는 문제가 제기 되고 있다. 이에 현행 토지보상법 등의 보상방법의 문제점, 특히 현금보상과채권보상의 문제점과 신설된 대체지보상의 내용 그리고 개정 법률 상의 남겨진 문제점 및 대체지보상의 개선방안에 대해서 구체적으 로 살펴보기로 한다.
Abstract
As for the Constitution, the Expropriation, Use, and Limitation of a Property Right by Public Need does as opposed to it as a law, but it is provided that 'just compensation' must be provided with article(23 ③), and a public principle as opposed to Limitation and compensation of a property right is being prescribed. However, it is being left to an individual treatment law without prescribing what kind of method a constitution must compensate by as against infringed property value. It is provided that a special rule provides other laws except a certain case in law (land compensation method) about the acquisition of land that it may be said that it is general law of loss compensation “Act on the Acquisition of Land for the Public Undertakings and Compensation”(it is called Land Compensation Law) hereby and compensation in cash, and a principle of cash compensation is prescribed. and it is compensating with a bond in the case of specification exceptionally article(65). Problems, of the compensation method of existing Law of the Land Compensation decides to well watched as against subject matter, revision legal problems on Compensation by SubstitutionLand founded a problem of cash compensation and bond compensation in particular and the improvement bill concretely here.
